re-filing for spouse visa

My fiancé was recently denied his visa for EWI twice before. He has a 9c ban for 10 years and after his 10 years they said he could file a waiver. He has been back in Mexico since 2010, so he only has 6 years left. I spoke with an attorney today he said if I went to Mexico and got married we could re-file and he could apply for a waiver. I would have to prove extreme hardship for myself and our daughter. This lawyer has given me some hope but I want to be sure this can be done before we do it all over again for nothing. Has anyone EWI from mexico and was approved the spousal visa? If nothing can be done I plan on going there to be with him but I want to make sure I've tried everything before I give up. My last lawyer seemed to just screw me over.

The comment left for you at immigrate2us.net was the correct answer. A 9c can't be overcome by marriage. You have to wait out the 10 years and then you have the option to file a waiver. There are entire forums dedicated to the 9c band. Best of luck :)

Your lawyer told you that a 9c could be overcome with marriage?

michele, tomorrow laurel scott (immigration attny) has a free chat session where you can ask a question, she is one of the waiver guru's and i would def speak to her if i was in your situation.

As stated, a 9C bar cannot be overcome by marriage. Run away from that lawyer.

Nope sorry! He needs to wait out his ban. Yes be careful with this attorney. Wouldn't like you to invest money or hopes when their aren't any chances. Good luck!
