So my fiancé just got approved for a K1 visa yesterday. She will be flying to the US as soon as she gets her visa. I understand she will need to apply for a SSN Can we get married after she has applied for her SS card but before she actually recieves one in the mail? I'd like to get married ASAP to put her on my work insurance.

Also, what documents will she need to apply for her SSN? Thanks.

Yes, she can apply for SSN before getting married. The SSN card has a lead time of 7-10 days from application. From my experience, I was not asked by our township for the SSN during the application of a marriage license. Although there is a space for it. But just to be sure, you can now download the marriage license application or contact your township registrar about it.

Here's a link for SSN application: http://www.visajourney.com/content/ssn

There is a special section there for K-1 visa holders. Wait for some days after her arrival, for her I-94 to be encoded in the system.

Good luck! smile.png

Do we NEED to have a SSN before we get married? Or can we marry first. Also, assuming we go to the SS office on Momday, don't get the card. Can we get married on Tuesday? Or do we have to wait for the card in hand to get married?

For few places, SSN require for Marriage License. You can always apply for Pre-Marriage License (may be online) and see if require SSN or not.

Gocubsgo1986,

We had a problem getting the SS card in a timely manner due to the government shut down last October. We were able to get married about a month before she received her SS card. I'm not sure how it is in your state, but here in Indiana they didn't need to see a SS card for the marriage license. We just had to show her passport (they also looked at her K1 visa inside the passport), her translated birth certificate, and I think we also showed the I-94 (can't remember that part).

We haven't really had to show to many people her SS card since she's been here, and she's been here 5 months now. Basically just to obtain her state issued ID card at the BMV, we used the SS card, passport, birth certificate, I-94, and two utility bills with her name on them. Then to add her name to my checking account we used the ID card, SS card, passport, and I-94.

Hope this helps smile.png

Thanks, guys. So I live in Illinois and the Cook county website states all we need is a valid form of ID, birth certificate and $60 for a marriage license. Anyone else from Illinois feel free to correct me?

I live in Cook County and I'm in the same boat as you. My fiance and I are planning to marry within 2 days of her arrival. We would marry fresh off the plane, however in Cook County your marriage license has to be 1-60 days old in order to be valid. From what I've been reading, you may have to wait up to 2 weeks to apply for the SSN so we will be married long before that. You don't need an SSN to marry provided you have some other documents. Details can be found here:

http://www.cookcountyclerk.com/vitalrecords/marriagelicenses/Pages/default.aspx

and here

http://www.cookcountyclerk.com/vitalrecords/whatid/Pages/default.aspx#special

I've copied the relevant parts here:

Special ID requirements for marriage and
civil union licenses One form of ID if submitting one of the following:
  • State drivers license
  • State identification
  • U.S. passport
  • U.S. Armed Forces identification card

- OR -

Any combination of two of these forms of ID:
  • Certified copy of Birth Certificate (English translations required for foreign certificates must be notarized)
  • U.S. naturalization certificate
  • U.S. resident alien card
  • Life insurance policy (at least 1 year old)
  • Foreign passport
  • Baptismal record (date of birth must appear)
  • Consulate identification card (matricula)

We are planning to use her baptismal record and foreign passport for evidence since those are the only 2 forms of ID listed here that she has. Good luck!
