In December (on the 6th) I filed for my AOS. It asked for my husband's current income so we listed it, but we were unable to include proof of income as he had only just got the job the day before (the 5th).

We received a request for initial evidence on January 6th asking for proof of his income, so my question is:
Will his proof of income be valid if he has only had the job since December?

We also have a co-sponsor (his mother) and the request states:
'The petitioner/sponsor's income on the Federal tax return does not meet or exceed 125% of the poverty guideline. The petitioner/sponsor lists their current income as an amount to be considered as sufficient.." and then goes on to ask for the proof of income, so that brings us to my next question: Why would it not meet the poverty guideline if we have used his mother as a co-sponsor? Would this be purely due to the lack of proof of current income? Or would this be to do with the lack of w2's and 1099's (which we have also been asked to submit as the tax transcripts we did send weren't clear since we had someone fax them over to us).

Thanks in advance for any help/advice, and I apologise if this was a bit confusing to understand, but I'm confused too!

They don't take your word for it. You have to give them something that proves what you wrote down. Get a letter from his employer stating his job, when hired, salary, and that it is full time.

Question: does the new job exceed 125% of the poverty level?

Did He send a tax return and W2s?

Mom's issue--

Did she provide an employer letter and some pay stubs to prove the income she stated?

Is her income over 125% of the poverty level for her household size?

Is her tax return joint with her husband?

Did she submit a tax return with her I-864?
