Do I file for taxes?...

You should file, because you will get more money back. Each person is worth like $3k. You can file married filing jointly and do it all at once. You will need a SSN though.

A K-1 is entitled to a SSN but it's too late for that now. EAD should be coming soon. I'd call and check up on it.

From reading your posts, you're like one of the last people I would have expected to assign a numerical value to someone's worth!

No, he cannot file as single because he is married.

I had a similar thing happen with my wife when we went to get her SSN in her maiden name with the i-94 and k-1 visa in her passport. The lady was adamant that "we need a green card to file for SSN." When I explained to her that you don't need one as long as the i-94 isn't within 30 days of expiring, she backed down. I showed her the how to file for SSN guide on VJ that I printed out that had some helpful tips as well as the SSA ID requirements PDF for new SSN's and she got the message. Might be helpful to bring that next time when you get the EAD/GC. Best of luck! :)

Thanks for the help, evidently she must have been brain dead just called the office and they apologized that the person I dealt with was incorrect...ARGGGG - this would happen to me. Anyways I called USCIS again and talked to a different person who put in a service request for me to find out what is taking so long on my EAD and AP.

Hopefully that will help my situation, appreciate your help! I was ready to tear someones head off.

He can file Married Filing Single (MFS), which doesn't give the same benefits as MFJ and dependent on how long you have been here you may not need to file for 2013 at all.

Hi all,

K1 visa entered September 10th, married September 20th, filed AOS November...It will be 3 months in 7 days that I've been waiting for my AP and EAD, therefore I do not have a SSN...My hubby was unsure if I needed to file taxes or not???

Anyone else have this issue?

First, relax. As of today you have 60 days to file your taxes. Second, there is this thing called an extension which gives you another 6 months to file your taxes. The rub Is that you must pay any taxes due or be very certain you are getting a refund otherwise you will have to pay interest and a penalty on any amount owed. So you have plenty of time to get the EAD and/or GC so you can get a SSN. You and your husband can complete your tax returns at anytime and see what the results are. Once you have the SSN, you fill that in and file the return. Your best tax situation would be to file as married filing jointly and for you to be claimed as a lawful permanent resident for TAX purposes the entire year--that is my guess, but you will need to run thru the other options available to see which one causes you to pay the least amount in taxes.

one question about taxes

Im usa citizen filing for taxes. I got married in Dominican Republic.

My wife lives in the Dominican Republic and im filing to bring her to the usa

with a I-130. My question is do i put her in my taxes for immigration purposes

or i dont have to since she doesnt have a social security number and has

never been in the usa. Is it ok for me to file as single??

You should start your own thread in the future, but since you are married you cannot file single. You can file married filing separately and put "NRA" in the spouse SSN box for "Non-resident alien." Good luck.
