Do I file for taxes?...

Timeline

Hi all,

K1 visa entered September 10th, married September 20th, filed AOS November...It will be 3 months in 7 days that I've been waiting for my AP and EAD, therefore I do not have a SSN...My hubby was unsure if I needed to file taxes or not???

Anyone else have this issue?

You should file, because you will get more money back. Each person is worth like $3k. You can file married filing jointly and do it all at once. You will need a SSN though.

A K-1 is entitled to a SSN but it's too late for that now. EAD should be coming soon. I'd call and check up on it.

A K-1 is entitled to a SSN but it's too late for that now. EAD should be coming soon. I'd call and check up on it.

The SSN office told me I was unable to get one until I get my EAD...and now my EAD is not here and I'm super frustrated because my husband needs to file for his taxes...Im calling them now

Chase up your EAD, Mine was in hand after 70 days and at a similar time to yours.

I got SSN as soon as I could, couple of weeks after coming in on K1.

I just called and she was not helpful at all..Told me I need to wait 90 days to find out anything else about my EAD or my AP...I am so beyond frustrated how inconsistent this entire system is.

What is the date on your NOA1?

We did. I came to America on Sep 19th, and got married on Oct 4th. My husband filed even though I haven't had a job. (he checked on the "has a spouse, but doesn't work" part.)

Is it still impossible to get a SSN with your maiden name? I applied for it after we got married, but with my maiden name. I haven't applied it with my married name yet.

I am so sorry for the EAD and AP. I got it last Friday, but it was later than the estimate time. Hope you get the card soon.

No she was extremely rude and said "Tier 2" wont assist me unless it's been beyond the alloted wait time...

I'm also calling the Social Security Office to find out why I was denied a SSN when I went in September.

Just seems no one is educated on this type of situation

How long after the 3 months did you end up waiting? Did you have any RFE's?

Okay. So back in September you were eligible for a SSN. There was a window, while your I-94 was valid, that you could get it. It sounds like you encountered a brain dead SSA worker who denied you. It happens too often.

But that's okay.

Your EAD is not yet at 90 days so you cannot enquire with them. In one week, if you have not gotten approved, call USCIS. I suspect your EAD will be approved soon. Make sure to keep checking your case status on all your cases.

Once you get your EAD, you can get a SSN, and it will be sent to you in a week or so. All of this will happen well in advance of the deadline for taxes, so it will all be okay. Good luck.

Thanks for the help, evidently she must have been brain dead just called the office and they apologized that the person I dealt with was incorrect...ARGGGG - this would happen to me. Anyways I called USCIS again and talked to a different person who put in a service request for me to find out what is taking so long on my EAD and AP.

Hopefully that will help my situation, appreciate your help! I was ready to tear someones head off.

Remember taxes need to be done by april 15th. It's only Feb 12th. You have time to get the SSN and do the taxes.


In Canada you likely wouldn't even have your T4 yet. ;)

And even if things are running late … you can get an automatic six month extension just by filling out the extension request. However, your taxes still need to be paid by April 15th lest you'll be responsible for penalties and interest for tax due but paid after April 15th. You can figure it out and, if you owe, pay with the extension request. Spouse with SSN can file extension request as married separate, but then file the return as married joint when the SSN is available. Tax due, if any, should be based upon married joint. If you anticipate a refund, it will only be delayed a bit until the SSN is available for filing.

I got married Oct 6, 2013. If my husband filed tax Married filing jointly, Do I need my Indonesian income from 2013? Thanks.
