Hi,

I got married in 2008 and received my GC in August 2009. I filed with the help of a lawyer here in Chicago (much to the annoyance of my husband ..he didn't want to spend 1000+ dollars on lawyer fees). My dad insisted that I file with the help of a lawyer ..there were a lot of unpleasant arguments that occurred between us and fast forward to now, my husband really hates to talk about anything having to do with my immigration (or citizenship)

So I need help bc I'm on my own and I want to file for citizenship this week. I became eligible in August 2012 (3 yrs) and since then I have had my forms ready, but never mailed them out because I don't have our tax papers and I didn't want to ask him for them. I am a stay at home mom and I do know that he files them jointly. So here are my questions:

1. Is there anyway I can obtain our tax records online

2. I live in Chicago, so what address should I mail my n-400 form to for the quickest response

3. I didn't know I could have applied for my parents' GC when I applied to remove conditions from my own GC..so missed that opportunity. My family arrived in 1999 with us on my dad's H1 and overstayed. I really want to apply for my parents ASAP. Is there any form I could send for them along with my n-400 which would start their GC process?

Thank you in advance for your help smile.png

So you're attempting to do all these things without even talking about it to your husband. Yes, I know you believe he will react negatively if you tell him because of the money spent on lawyers fees. But does that make it right to do things like this without him being aware? He's your husband! There are ways to disclose it to him without eliciting a negative reaction. Be wise!

I stand corrected!

As long as they entered legally and stayed in the States (which is both true in this case), they are eligible to adjust status without leaving hence no need for a waiver.

Shikagodesi, please keep in mind that if they leave the country before gaining legal status, they will trigger the ban and you will not be a qualifying relative to overcome that.

Good luck!

Edit: typos

So I just mailed my application today ..about an hour ago. I sent almost all supporting documents, (for 3 yr rule) except tax returns ..the IRS website that someone posted here where we could print tax transcripts was not working for me -kept giving an error message. Also sent G-1145 with my n400 by express mail. They will receive it tomorrow

Tax return transcripts are not a must, so long as you can send other evidence of your marriage. You might have sent copies of your tax returns, for example. They're not evidence that you actually filed, but they're better than nothing.

Can somebody tell me which date to go by to file n400. The form ask when my wife became permanate resident and the GC states Resident Since 12/21/2011 but she arrived May 2010 and we got married within the 90 day period in 2010.

Also she went back to Philippines on vacation for 3 months so are those 3 months subtracted from the Resident Since date which would push the date to March 2012?

If filing under the three year rule then she can file 90 days before the three year anniversary of the "Resident Since" date on her green card.

Thanks for the reply and info. I actually called the USCIS customer service number to ask this question and they are totally useless, they told me that they don't have acess to my file and I need to make a info pass appointment to get the answer. Which would mean I would have to take off work and drive 50 miles to ask a simple question. They seem to only have a very basic scripted list to go by and can't answer this question.
