Timeline

my fiance and i will get married this thursday. afterwards, we will apply for adjustment of status, AOS. do we also apply for employment authorization, EAD, at the same time? i have tried looking through the guides and searching the web, but im not certain. i thought it was recommended to not apply for work authorization before getting married because by the time it was approved, we would be married already. also it would save us the application fee, because if we waited until applying for it at the same time as the AOS then they would wave the fee. this is what i gathered, but does that mean we still apply for EAD when we apply for AOS? (my fiance came here on a k1 visa from tunisia)

The latest fee for AOS is I-485 $985 + $85 biometric fee for a total of $1070



EAD (I-765) and AP(I-131) are free with AOS filing.



You would want to apply EAD & AP together with AOS.


You never know how long the AOS would take.



With EAD & AP, your spouse could work and travel out of the country in case of emergency

Yes, you apply EAD and AP together with AOS.

EAD will grant him permission to work for 1 year (before Green Card approval).

Once he has the Green Card, he does not need EAD anymore.

File all 3 at the same time, then you should get EAD and AP after 2-3 months, GC could be much longer
