Hey,

Hoping someone can give me some information on a few things as I'm totally confused.

I came to the US under a K1 visa in Feb 2012. I'm now married to a US citizen. My passport stamp visa says the expiration date is AUG 2012, and since getting married I've not filled any additional paperwork except for getting my SSN.

I want to apply for the I-765 so that I can now work, so I have a few questions that hopefully someone can help with:

What is my current immigration status?

Am I allowed to file the I-765 without adjusting my status to permanent resident? I can't afford to pay the $1070 at the same time so need to work first in order to be able to pay for it.

I know that I've waited a long time to do this, do you think there will be any problems?

You are out of status and could be detained by ICE at the current time.

You cannot file an I-765 without filing for AoS first. The good news is, when you are finally able to file and pay the fee, the overstay you have up to that point won't be a barrier to obtaining your green card.
