Hi guys...

With my past post.. I have shared that we have two statuses on our ceac status, which is: AP and refused. I'm checking our status everyday and they actually, update it everyday. Like I said with my previous post. I thought we our already refused. Because that's what the lady told me the last time I called the embassy. She told us they're returning our documents and passport last week and I will receive a letter by d week... However, now i have second thoughts. I think we our just under AP like our other status says..

They still did not return my passport. Us embassy still didn't send me a formal refusal letter. And our status is updated everyday... Do you think this ai a good sign? Does it even matter if it's updated everyday? Does anyone has any clue?

Update? Meaning the status has changed or the date is changing only?

I would be nice if they were giving you situation more consideration. I will keep positive vibs goine your way.

Change of date only hank.. Is that a good thing? Does this mean they are working on our case.

I truly appreciate you reply mu post hank... In some ways it help me calm down a bit.

Your visa application was refused because your fiance's current sustained income was not enough to satisfy the consular officer that you would not become a public charge in the U.S.

It's likely that the Embassy eventually will send your fiance's petition back to the USCIS where it will expire.

Perhaps sending the Embassy your fiance's joint sponsor's documents might help.

Hi tahoma,

I sent in a joint sponsorship from my fiancé father... Hoping that it would turn well... Because the last time I called which is last week monday.. They told me we are refused and they will return all my documents and passport. But I tried sending our co-sponsorship forms and documents including a letter asking for reconsideration the next day. The week has passed and they still did not returned anything to me.. I hope the follow up documents I sent was bit helpful in our case.

I assume, if we are really denied.. They have to sent me a formal writing explaining why we are refused.. But I never receive any...

I was actually expecting them to return my passport and documents by now since it's passed 2 weeks since I gave them the documents...

But I guess, considering they are just changing the date from our ceac status and nothing was given back... There might be a change of getting a visa issued... I hope... But won't be expecting tho.... Expecting the worst so it doesn't hurt so much...

I don't know that only the date changing daily is a good or bad thing being the status isn't changing. Usually that means someone has "touched" the file.

Thank you hank.. I'm just hoping a slight chance here.. :)

If I were in your shoes, I would email the Embassy immediately and notify them that you intend to submit proof that your fiance's current sustained income exceeds 125% of the poverty guidelines.

I say this because the Embassy normally gives you one year from the date of your interview to respond to a 221g. Since you have already responded to the 221g and have been refused, it makes sense that you should notify them that you intend to follow up with another submission proving that his income has increased in 2014. I hope the Embassy will allow you the remainder of the time remaining on your 221g to submit additional documents.

In the meantime, your fiancé needs either to get a job which puts him over 125% of the poverty guidelines, or get a part-time job which will supplement the income from his current job. Then, you can submit several of his current pay stubs to prove that he surpasses 125% of the poverty guidelines.

In my opinion, the most important thing for you to do is to make sure the Embassy does not return your case to the USCIS. If the Embassy keeps your case, then you have a chance to satisfy the 221g.

I hope it's good news too. Maybe they decided to accept the joint sponsor.

I'm curious...Is your fiancé Pinoy?

Posted

I hope they did accept the joint sponsorship.. And he is not pinoy... :)

I have seen the USEM accept joint sponsors from non-Pinoys, but it isn't very common. I hope you are one of the lucky ones. Please keep us posted.

Hi hank, just wondering... Did u ever came across to a vJ member who has a "ready" open case status on their ceac.. But visa was not issued?

I've been ready other people post... Most of them got an issued visa after 2 business day when they got their ceac status ready...
