When to file citizenship

My friend is under IR-1 with 10yrs gc. They been married for 5 yrs now, but just moved here and got her gc for 1.5 yrs.

When can she file for us citizenship? She was told she needs to be in the usa for 3 yrs to be able to file for citizenship?

If you married to a USC, you just need to wait 3 years

You only need to be in the US for at least 18 months and the rest you can be in Manila or anywhere else

Note: you cannot be absent for more than a year

i.e., you can go to Manila for 3 months then back to USA and again you can be out of the country again, but make sure you need to be physically in USA for at least 18 months to be eligible for Naturalization

jkelly07 is right check the read the instructions n-400.

You need to take your time and read it carefully, it’s there under ” Naturalization Eligibility Worksheet”

Thats what i know also, married to usc for 3 years. When usc filed for her petition, they been married for 3.5 yrs already. She got 10yr GC. Shes been been here in the usa for 17 mos total..so 1 more more month for her to be able to file citizenship?

Huh? Op i think you got it wrong. Read the replies carefully.. She can file for citizenship after about 3years from the time her ir visa was activated. If she is in the us for 17 months.. She has 18 more months before she can file for citizenship. But she can be outside the country as long 18 months is spend in usa

Check the "Resident Since" date on her Green Card... and than add 3 years to it - that will be the time when she can apply (minus 90 days)

Sept. 2004 - We met online

05.17.2005 - His first visit in Poland

07.21.2005 - My first visit in the U.S

06.01.2010 - Got married in Phoenix heart.gif

06.23.2010 - Filed for AOS

12.08.2010 - Conditional Green Card

09.09.2012 - Filed for ROC

17.06.2013 - 10 year GC received

Citizenship:

09.09.2013 - Filed N-400

10.04.2013 - Biometrics

12.17.2013 - Interview - approved

01.24.2014 - Oath Ceremony - U.S Citizen dancin5hr.gif

01.27.2014 - Applied for Passport

02.08.2014 - Passport received!

02.12.2014 - Got my Naturalization Certificate back.

I’m not very familiar with Immigration Law/s or Policies

Being an airline crew my wife travel a lot almost every 2 months

Out of 3 years she was physically in USA for 23 months, she was never question why she’s out of the country a lot

I’m only sharing you her experience

Before she travel to Manila my wife filed for her N-400 and approximately 7 or 8 weeks, I received a letter and date for her interview, she came back for interview and traveled back to Manila, then 4 weeks later I receive a letter stating the date of her oath taking

During the interview she was asked 7 question all related to either laws or history of the US and was given 2 English words that she need to write a sentence

Thank u all for your replies and clarrifications. I didnt know exactly what to tell her when she asked me when to file for her citizenship and somebody told her 3 yrs. i guess thats right! Ty all! And God Bless!

Just be sure she understands...its NOT 3 years married, its 3 years from the date she activated her visa. Whatever the date is on her green card, 3 years from then.

November 15, 2010-Sent off VERY late I-751 along with many prayers.
04/09/2011-10 year GC arrives in mail.
09/08/2011-Glyn leaves for UK
01/30/2012-Biometrics for UK spousal & dependent visas sent out w/ application same day
02/24/2012-UK settlement visas issued

04/16/2013-I-130 sent off-----04/19/2013 NOA1

05/15/2013-NOA2

Never received packet 3 although it was mailed to us on May 29th

07/17/2013-Sent off packet 3 after finally getting ALL our documents together

08/19/2013-Medical scheduled (there were earlier appointments but unfortunately, we couldn't get there for them due to hubby's work)

09/24/2013-Interview APPROVED

11/01/2013-POE BOSTON

01/13/2014-10 Year green card received

03/09/2019- Sent I-130 to Chicago lock box for step-son

03/20/2019- NOA 1

Actually there are several items that must be met in order to file for USC. The first is are you married to a USC or not. If you are married to a USC then you can file after being married for 3 or more years. There is also the physical presence rule that states that you must be a LPR resident for the past 3 years or 5 years. So the worksheet goes like this: Are you 18? Yes. Are you are LPR and have your GC? Yes. I have been a LPR for the past 3 years? YES . I have been married to and living with a USC? YES. I have been married to that USC for the past three years? YES. The USC citizen has been a USC for the past three years? YES. During the past three years I have not been outside the US for more than 18 months? YES. Then there are other items you need to see if you fulfill.
