how to bring my child over to US

I am a permanent green card holder and just moved to US last year but i had a child out of wedlock but i didnt include her when i filing for my i-130 form as i married a US citizen but now i want to bring her over to Us.my name was not on her birth certificate because i had problem with her mom and she decided not to include my name on the birth certificate.please now i want to file for her to move here.can somebody give me the guidelines and how to file it and if we need a dna and documents i have to provide to uscis.shes just 7 yrs old and a british.please i need your advise

Likely there is no way even if the mother gives up custody...at least, not quick, because being the child of an LPR (assuming she is), that category F2b is numerically limited and thus she is not considered an immediate relative....sounds like a real mess as far as ever proving you were the father, and how you would ever gain legal custody....

Your US citizen spouse can petition your 7 years old child as a stepparent. This would be an Immediate Relative case and take about a year for an immigration visa.

To get your child a visa, you will absolutely need 2 things;

1. Proof of parenthood with a DNA test, and

2. Consent from the biological mother for the child to immigrate to the US permanently or a court order allowing your child to immigrate.

Your US citizen spouse can petition your 7 years old child as a stepparent. This would be an Immediate Relative case and take about a year for an immigration visa.

To get your child a visa, you will absolutely need 2 things;

1. Proof of parenthood with a DNA test, and

2. Consent from the biological mother for the child to immigrate to the US permanently or a court order allowing your child to immigrate.

The DNA test will be done after the interview at the embassy and takes about 3 months for results to get back. But if I were you so there is no doubts I would get a DNA test before you even start.

I have seen on 2 occasions Nigerian fathers petitioning who they thought were their children just to find out after DNA test they were not his and guess what they are banned and labeled a child smuggler. Maybe not all but in these two cases they were men who raised they children from infancy.

But since you are the father a consent from mom is very much needed. Doesn't sound easy either. All the best.
