Hello VisaJourneyers,

First some details: my girlfriend entered the country on a B-2 visa on September 5, 2013 from her home country of Israel. Her visit expires on March 4, 2014. In January we decided to get married and apply for adjustment of status.

We have filled out all the required forms, but are left with a few questions.

For the sponsorship form: I-864, I myself didn't earn above the poverty guidelines in 2012 and my father agreed to be the joint sponsor. However, because I was in school for 2010 and 2011, and didn't earn over $10,000 in 2012, I didn't file taxes. I wrote a letter to explain this, and it reads:

To Whom It May Concern:

I am *Coolie Renrut*, Mrs. Renrut's husband and petitioning sponsor. I did not file an income tax return for the years 2010, 2011 or 2012 because I had not earned sufficient income required for filing each of those years. 2010 and 2011 were spent in school earning my bachelor’s degree, and in 2012 I spent time in several unpaid internships and low-paying temporary jobs. I was supported by my mother and father’s income and savings. Since I was below the $10,000 income level, I was not required to file an income tax return with the Internal Revenue Service.
I started my full-time career in December 2013 in technical support for an imports business and then, on February 5, 2014, I changed employers to pursue a higher salary and a more professional career-building experience in technical support. I haven’t been able to be the sole sponsor of my wife, Mrs. Renrut's adjustment of status petition because I haven’t earned enough money; only in these last few months have I started to build my career, and I have now begun earning a qualifying salary. I have attached a form I-864 indicating a salary of $29,120. Also I have an employment letter included from this current job.
Although I have begun earning the means to support myself and my wife without being a charge to the public, I have the co-sponsorship of my father, Mr. Renrut Sr., who can assist us as needed, and who has also filled out form I-864 as part of this sponsorship.

Is this an adequate letter for my situation? How do I indicate on the tax return portion (page 6) of the I-864 form that I have attached a letter explaining why I don't have any to report?

Another question I have is in regards to the household size (Part 5, Page 4) of I-864. Currently myself, my wife, and the joint sponsor (my father), live at the same address. Should I count the household as 3 people? The form states that if you're combining your incomes to satisfy the income requirement, to count the person, but since the joint sponsor is able to satisfy the requirement on his own, do I put down the household size of 2?

Lastly, if me and my wife move to an apartment, does she need to send a notice of changed address to the USCIS immediately?

You only need a simple, straightforward statement. It just needs to state that you did not file taxes for the last 3 years because you did not meet the income threshold to be legally required to file.

Hand-write "SEE ATTACHMENT" for Part 6 #13

You won't be combining incomes. He will be filling out his own separate I-864. You do not include your father on your I-864 for your household size. Your father will not include you in his household size on his I-864, unless he claimed you on his most recent taxes.
