USPS lost EAD card. USCIS still insists we re-file, re-pay and re-wait

Same thing happened to us, but we just waited for the greencard which arrived a couple of months later. But you might not want to wait that long.

If selected for an interview waiver then it could be a year or so before the green card appears; I wouldn't want to wait that long to get some kind of photo ID, as well as employment and travel authorisation.

You are right. We have our AOS interview in 2 weeks and at this point, we will probably have the 2-year green card before the EAD card. But all travel plans are off the table now. She wants to work and get her driver's license. Living in NorCal is impossible without a car. You have all been through this and you all know how cabin fever wears on a person.

I will pursue this with the post office. We know they got the package because it was scanned at the local office. I will push hard on this one.

Since your fiancee isn't working right now, she has all day to be down there badgering the local post office and be making phone calls where they lost it. Make them aware of this.

I have heard of this a couple of times here previously, when USPS "lose" either an EAD or green card, then the alien has to pay the I-90 fee to have the green card re-issued.

In the specific case of an EAD, I would simply re-file a completely new I-751 application, and enclose a covering letter with all of the relevant information from the first card (case number, tracking number, you didn't receive it, etc.). I certainly wouldn't be paying a fee.

Technically you'd be making a renewal application, and usually that requires you to submit a copy of the current EAD. That obviously won't be an option in your case, so I'm wondering how they would handle that.

I would also contact one of your congressional representatives and / or the DHS Ombudsman to see if you can get some traction that way.

Been there done that. We never received my wife's green card and they denied the I-90 saying their system shows it was delivered. (It wasn't).

Fortunately, we have to do the ROC so we are just going to wait it out. They already put that stamp (sorry don't remember the name) in my wife's passport to allow her to travel, so really we don't need the green card.

This is really bad news BUT maybe just wait for your Green Card instead of re-applying. I received my Green Card 20 days after my E.A.D. Not sure what the times are like now, mine was done in 2011.

That does indeed SUCK!

I have had similar problems but with less important pieces of mail, than yours with USPS, and they will never take RESPONSIBILITY for anything the screw-up. I wish that all important mail would be sent either Fedex or UPS, they will take responsibility and at least attempt to make things right, although there process is very slow, they do, do something, other than shrug there shoulders.

Close to 3 years ago, after having had previous problems with USPS, they had "lost" a piece of my mail that was rather important, so after getting no satisfaction other than basically saying OOOPS, I contacted my local congressional representative, and made an appointment to go in and talk to a member of his staff in person, less than 3 weeks later, I got an apology, along with a check to reimburse me for the money I was out, from USPS. So USPS can at least be forced to be responsible somewhat. So I would try that, it did work for me. Since USPS is rapidly going bankrupt, the last thing they want to do is take any kind of financial responsibility for anything, so I hope you will succeed also.

Why USCIS cant just reissue the 2 documents again is beyond me, but then thats what govt. offices seem to do, is take something that should be easy or resolvable , and make it complicated.

My husbands EAD card was also undelivered as the OP stated in her case. I called USCIS and no one ever said we had to pay any additional fees or reapply. They simply sent another one and within seven days he has his combo card.

Maybe OP could keep calling USCIS until someone agrees to send out a replacement. Talk to ten different people if you have to.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

This is the only way to get valid information from USCIS. We did the same when my wife's name was spelled incorrectly on her GC. The guy we spoke to was curtious and very helpful.
