Hi every one. My wife was 18 last year and she file her tax as dependent on her parents,she did make some income(but I don't think she make enough need to file tax), but the 1040 tax return is her whole family all there. How to fill form I- 864 part 6 line 13? It ask ___ "I have filed a federal tax recent for each of the three most tax years. I have attached the required photocopy or transcript of my federal tax return for only the most recent tax year "

then 13a, b, c is each tax year and the total income.

Should I make form I- 864 part 6 line 13 as filed federal tax or not?

Also Do we write a letter tell the USCIS about this?

It's not clear what you're filing for, whether AOS or other. Is your 18-year old wife the petitioner? Are you the beneficiary? Did you have a co-sponsor to get a visa? Who was the co-sponsor?

Her parents filed a tax return, and not her. She was a dependent on their taxes. She does not use her parents return as her own. Since she did not file taxes for the last 3 years, she must include a statement as to why she was not legally required to do so, as per the I-864 instructions >

"If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation."
