Apologies if this has been answered already but I dont think it has. My husband started employment in the US in January. He s sponsoring me and my daughter . Which form do we need to fill out? Im not sure about the W2 situation. His boss has given him a letter to say what he is earning and my husband submitted his tax returns for the last three years . He was not working in the US , he was abroad so his income will not count

Thanks in advance

hi

the i864 because he will need a joint sponsor, since he never filed taxes

so he will file the i864 and the joint sponsor will file their own i864

unless he has a lot of assets

He will need to use the I-864 because he doesn't show above the poverty guidelines on one more more w2.
