Visa will expire

I applied for a tourist visa for my mother in law last summer it was approved and she spent the summer with us. Did not overstay everything is aboveboard. Her visa was good for one year we want to bring her again this summer but the visa will expire while she is here for the summer.

Question is do I reapply for a new visa before she comes even though hers is not expired yet or do I take her to the embassy while she is here and get an extension.

Yes, she needs to renew.. She will not be admitted if her visa ill expire during her time here... Many times the immigration requires at least 6 months validity ...

I don't know if this apply to you or not. I got a tourist visa too. B2 visa in particular. My visa expire October 2012, I enter in August 2012 stayed all the way to January 2013 with no issue.

What matters is the stamp on the passport that says you can stay till a certain time.

The visa in passport has dates which show how much time she has to cross the US borer.

How long she can stay in the US - that's the CBP decision.

She can stay a way pass the dates in her passport, as log as she doesn't stay longer than her I-94 allows.

The validity date on a visa does not control the admission time....think of a visa as a document that gives the holder 'permission to ask to be admitted into the US' (or some other country)....which means, as long as the visa itself is valid, one can use it to ask permission of a country's border officials for entry to that country....for how long you are admitted is something different.

Best thing is to renew the passport as some CBP agents might not issue an I-94 beyond the expiry date of the visa. But she could also take a gamble and still come over, only problem is she might risk being given an I-94 with a shorter date.

Not true...visa validity and admission times are not dependent on each other...a visa allows the holder to ask permission of a country to enter its borders; the validity of a visa is for how long one can use it to ask permission for entry.

If you are talking about a US visa, this is absolutely NOT true. The visa date is the date by which you can apply to enter the US. The length of stay is determined by the immigration official at the Port of Entry. You could enter on a visa today that was expiring tomorrow and stay for 6 months in the US, if that's what US immigration authorized when you entered. The visa date does not matter once you are in the U.S.
