As Gary said, Legitimate husband and wife do not get rejected. I agree with that. But what if that legitimate husband wanna call USCIS and say the wife married him to get the green card because he wants to file for divorce and see his wife suffers from these paperworks :crying: . There is no proof of sending money or anything. But Im still scared if they may believe in his words. We dont have any joint bank acct and he didnt file tax jointly with me, Im so tired with the divorce and this green card :help:

Legitimate husbands don't do that, hence my answer. You are getting a divorce, you have no "legitimate husband" and cannot file jointly successfully unles he cooperates. You will need to complete the divorce and file separately with an explanation of why you are filing separately and how you entered into the marriage legitimately. You can receive ROC with a separate petition after a divorce.

I did not address the issue of separate filings in my inquiries about evidence. Perhaps I should have.
