So the letter I got basically said that they had transferred (on Dec 26th) my file to Nebraska, and that we should hear from them within 60 days. (tick tock tick tock) .. :)

Thanks everyone for the advice .. I can't wait to get this process over and done, and begin the next stage.

Definitely submit the AOS package asap (I-485, I-765, I-131, I-693, I-864, G-325A) along with a copy of the NOA1 and notice of transfer to Nebraska - very important. You don't need to have the I-130 approved in order to submit the AOS.

Once they receive your AOS package, they will locate your I-130 at Nebraska and join it with your AOS filing.

I can relate to your situation although my I-130 was transferred to Nebraska since mid-September and it's still collecting dust...they are the absolute slowest service centre. I can't wait until we file the AOS so they will join up our I-130!

06/20/2014: (112) Green card was approved.

06/26/2014: (118) Received e-mail/text notification of green card approval and that card was also mailed. Received USPS tracking number at 6:45 p.m. EST.

06/27/2014: (119) Received green card in the mailbox.

Darn, I wish I had found this group prior to me starting this journey .. I was under the impression from the wonderful 1-800 (mis-information line) that I had to wait for each process to be filed separately. Thank you for all your advice .. I've heard varying stories about Nebraska, and I can assure you .. we'll be looking for the papers as of next week ;)

Now to get the $$ together for the next phase .. I'm scared to even look at how much it is ................

sooooooooooooo I have a few updates .. if you can help me figure out what they're doing .. I'd appreciate it !

First, as of yesterday, March 6th, my I-130 is approved dancin5hr.gif

Then, I got this this morning ..

Your Case Status: Post Decision Activity
On March 7, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing.

I'm so confused now ... any advice form those of you who have been where I am ?

It sounds like they have processed the I-130 for an IR1/CR1 visa and not for adjustment of status.

Did you ever file the AOS forms like you were advised to?

How did you fill out the I-130? Did you list your US address as your current address? Did you say you were currently in the US and provided details?

When I filed my I-130, I was already living here, but I do believe that my address was my Canadian one at the time. I have filed the original papers, and don't have them with me right now.

My husband and I will be married 2 years in June. I have NOT filed any further paperwork, as we were waiting to see the status on this before proceeding, considering the amount of money it is for the whole process.

We plan to file the rest of the paperwork within the next few weeks.

Can you still receive mail at your Canadian address? I strongly suspect that due to the way your husband completed the I-130 that it has placed you on this track - http://travel.state.gov/content/visas/english/immigrate/types/family/immediate-relative.html

I have no idea how you can change that, I think you may need to have the I-130 transferred back to the National Benefits Center so you can then file your I-485 and supporting paperwork but they may do that automatically, I really don't know, hopefully someone else on here knows what the next step is.

Btw if you had have filed for AOS back when you first filed you would have already had your green card for about 6 months now, probably longer but now there is no telling how much longer it will take.

When we filed, we said I was here. That I had crossed the March before, and had not left ... I'm going to have him call. There are 2 types from what I see, and have read. With any luck, the planets are all aligned, and we won't be held back anymore. I'll talk to him tonight about it. They will only speak to him right ? Or can I call as well and ask the questions, even if he's the petitioner ?

When we originally filed, we spoke to the MIS-Information line .. and was told each process had to be done a different times :( I wish I had found you guys before

If I understood correctly they sending your case to embassy in Canada for cr1? I started my proces in Europe and than I decided to file AOS here. We called uscis to ask about switching and they told us to file I485 with copy of noa oi130 and they will request the case back. But I think you will have to call them and tell them so they can get the papers back,

Well, it's official !! I got my I-130 status approved, I have the paper in my hot little hands :)

Now, I'm unsure of what to do next .. they say the have sent the original Visa petition to the Dept. of State National Visa Center, in NH, and that they will be contacting me (the beneficiary) concerning further instructions.

So, what do I do now ? Wait for them, to send me more information, or go ahead and file for my AOS ? I'm so confused ...

Any opinion on what is the best option at this point, and the least expensive I guess .. I'm already in the USA, because we were informed by the "mis" information line that once my paperwork was started to NOT leave .. so I haven't. The address I have in Canada, I do NOT get mail at anymore. So, should we contact them and give them my new address here, or give them another address in Canada. The visa won't be any good for me to CROSS the boarder .. and since I'm here already, I don't see the feasibility, and think that I should tell them that I am already here, and would need to have the process completed in the States ...

OR

Do I go back to Canada ... and wait ............ :(

Stay. File your I-485 with your approved I-130 and you should be good to go. Within 3 months you should get your green card. Unless you have pressing things back home to address or you want to go back to Canada and wait for a long time. Choice is yours but I will suggest the former if your being here won't affect anything back home in Canada.

Well for starters the I-130 is just a petition by the petitioner it's approval doesn't grant any kind of status to you the beneficiary, what they are doing now is this step of the process - http://travel.state.gov/content/visas/english/immigrate/types/family/immediate-relative.html#6

You need to file your I-485 (and supporting paperwork) with a copy of that I-130 approval notice and provide some sort of explanation that the circumstances have changed and you are now adjusting from within the US so they can get the file back in order to process your I-485.

No such explanation would be needed, you would just file an AoS packet with a copy of the I-130 approval notice in lieu of an actual I-130.
