Hi everyone,

I'm not sure if I'm in the right place, but I filed my I-130 in Jan 2013, and we got a notice on December 24th that it had been transferred to our local office. Today I got an update from them, with the following message: I must also mention that I applied from inside the US, after my husband and I got married. I'm confused as to what this may actually mean for my case. Could someone please help clear it up for me at all ? I've tried to search, and most of it pertains to I-485, not I-130 applications.

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN
Your Case Status: Card/ Document Production

On February 7, 2014 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

If you do not receive your document, please contact our National Customer Service Center at 1-800-375-5283.

Thank you so much !!! I was trying to remove it from the other room, and couldn't because of browser issues.

My Question to Hypnos :

What would indicate that it's a mistake. I'm confused ...

My understanding is that once my application for changing status was approved, that I would then have to file a I-485 to get my working papers. I guess I just don't understand :( sorry

The I-485 approval is what grants the green card. The I-130 is a petition and no card production would come out of it. You should have filed the I-130 and I-485 together at the same time. And, the I-765 is the form to provide in order to get the EAD for employment > http://www.visajourney.com/content/i130guide2

Whereas the message indicating that a card has been mailed is wrong because the I-130 in itself is just a petition that allows for a spouse of a US citizen to adjust status and therefore does not come with any card production or issue, I believe it is an indication that perhaps your I-130 petition has been approved. I would call USCIS and check with them on this issue. If possible talk to a Tier 2 person if you can

And yeah you could file them at the same time. Filing it separately tends to somehow take a longer time to process, probably they have the assumption that it's a K1 petition.

Thank you that at least gives me an indication. I'll have my husband look into it and call them. I was under the impression I'd have a card of some sort to show that my status was valid if I ever got stopped or questioned.

I guess my next question ... can I apply for employment authorization papers while I wait for my I-485 to be processed ?

Filing an I-130 by itself does nothing for your status. Unless you are legally present on some other visa, you are illegally present in the US and could be detained by ICE.

WOW .... I'm so confused now ...

When I originally spoke to USICS .. they advised me of what steps to take, and I've been going by that. I explained to him, what we were doing, and why ... he advised us to file the I-130 and once that was complete to file the remaining paperwork needed ...

I don't think anyone would assume they were filing for a K-1. Fling for a K-1 does not involve an I-130 petition. The K-1 process starts with an I-129F petition, and also does not involve any card production.

Yes, don't leave. Filing for adjustment of status will put you in a new period of authorized stay, so you need to file the I-485 and supporting documentation. You will include a copy of your I-130 approval notice, since you did not file them at the same time.

Call the USCIS, but never talk to the person that answers the phone. They are notorious for giving out misinformation. Ask to speak to a tier 2 immigration officer that has access to your case information. Ask, the tier 2 IO about your case status. Perhaps your petition was approved and they just sent out the wrong status message.
