What happens to the NVC process if no longer current (PD retrogresses in next Visa Bulletin)

Hi All,

We are in the middle of the NVC process where we just sent off the Affidavit of Support (PD of June, 2013). My Wife and I are extremely worried that our NVC process will be put on hold if it does not complete prior to a retrogression of the next Visa Bulletin (i.e. It could retrogress to what Mexico is at with 15 April 2012).

Does anybody accurately know when the NVC process cannot be put on hold due to a PD retrogression?

A visa can only be issued when the PD is current.

If the PD retrogress and us no longer current, the NVC will continue processing the case and forward it to the US Embassy where it will sit until the PD becomes current again. Once the PD becomes current again, then the interview will be scheduled.

can I also add that it is possible to get to the interview stage even though the PD is no longer current....just because the machinery may be slow in adjusting to a retrogression.....in which case, even though you have the interview, it will be noted that there is no visa available to issue to you. your file will be put on hold pending visa availability.

so make sure you don't add any unnecessary delays to the process so you can get to your interview as soon as possible.

03/24/15 : Case Transferred from VSC to CSC

03/28/15 : Hard copy of transfer received in mail

04/14/15 : NOA2 ( I-130 Approved) - finally! (informed via text on 4/16/2015)

NVC -

04/29/15 : NVC received the case (informed during phone call to NVC on 5/01/2015

05/08/15 : Case number assigned and IIN (received via phone call on 5/14/2015)

05/12/15 : NVC Welcome letter mailed

05/19/15 : NVC Welcome received in mail

05/29/15 : DS-261 Finally Available on CEAC and completed

05/29/15 : AOS bill Available on CEAC and paid (status: IN PROCESS)

06/02/15 : AOS bill status: PAID

06/15/15 : IV invoice generated (notified by email) but unable to pay on CEAC...waiting...

07/05/15 : IV bill Finally Available on CEAC and paid (status: IN PROCESS)

07/08/15 : IV bill status: PAID

07/08/15 : DS-260 Available

07/12/15 : DS-260 completed and submitted

07/13/15 : AOS and IV package mailed to NVC

My PD is 09 SEP 2013, ouch! just a day after cut-off. Okay here is the thing, even though my PD is not current, NVC still processed my case and collected all supporting documents. Shouldn't they have stopped processing it because of non-current PD? Or do you think I will make it to interview even though I am not current and then have to wait for actual visa to be available?

hi shadowflex - I don't have any answers for you but I hope and pray you get through. just go as far as you can go ... and be ready. you may only get a small window of opportunity.

knowing you and how lucky you are you'll probably get an interview date and during your actual interview pd moves forward!!!

That is pretty much a useless site who are just copy pasting from VB and other websites. To really make a prediction on PD, you would need Demand data for F2A up to Feb 2014 and also know the number of pending cases. They don't have any math done to know the exact numbers and basically repeating what was already said in the VB starting Oct 2013 to March 2014.
