So we saw online that our case is now being scheduled for an interview, and now we're starting to get everything ready for that. The only problem is that my husband doesn't have an I-94.

He entered the states on May 9th 2013, but wasn't given an I-94 at the POE (from what we can tell it's all stored electronically now). So we went online to the CBP website and entered his information, but it just says "Nothing found".

Is this going to be a problem at our interview?

The automation was not fully implemented until May 21. Your airport may not have been automated on May 9. It went in groups. The first group was Charlotte, Orlando, Las Vegas, Chicago OHare, Miami and Houston.

On May 7 they were to start implementing at New York, Boston, Buffalo, Baltimore, Detroit, Atlanta., Tampa, Puerto Rico, and New Orleans.

On May 14 it rolled out in San Francisco, Tucson, El Paso, Seattle, Portland (including Alaska), Los Angeles, San Diego, and Laredo.

VWP often cannot retrieve an I-94.

If he has a passport stamp as proof of legal entry then that should suffice.
