Timeline

So I'm pretty nervous and I haven't even filed to adjust my status yet. I have past drug use history, and it was fine for the K-1 visa because I am not a current user, have no criminal record and had everything I needed to prove that.

On the I-485 the questions that says, "Have you EVER, in or outside the United States: Knowingly committed any crime of moral turpitude or a drug-related offense for which you have not been arrested?" I obviously have to say yes as using drugs is a drug related offense. I plan on submitting a letter explaining and copies of all the evidence I already provided for the K-1 medical exam, as well as another character reference letter from my husband.

I want to believe that it's all going to be fine but I'm so worried about the interview. Is this going to be enough? Am I going to need an attorney? Although I would be okay with it I don't think I'll be one of the people who gets an interview waiver! I would appreciate anyone's thoughts.

just so i don't create a new thread on a sorta related topic...

I (petitioner) had to do community service for a misdemeanor marijuana possession charge (which was actually reduced to an infraction thanks to Arnauld Schwarzwhatever). do i need to take court documentation to my wife's AOS interview? the note they sent in the mail about bringing all arrest/police/court documentation...they said "if you" and i'm not certain if they are referring to the beneficiary to us.

Provided the petitioner has no AWA-related issues then USCIS won't care about it.

The Adam Walsh Act; it specifies that US citizens and LPRs cannot petition for certain visas if they have been convicted of certain crimes, usually involving sexual activity with minors.

Provided the petitioner has no AWA-related issues then USCIS won't care about it.

If that's the case and my situation is not related to that, and I've already been fine to this point then wouldn't I be okay for the AOS too? Without consulting an attorney?

No, since you have drug issues which may render you inadmissible. Speaking to an attorney in your case is highly recommended.

when i had questions that i couldn't find an answer to on visajourney, i contacted a few lawyers, and among the many i contacted this lawyer was the only one that gave me a comprehensive email response without trying to sell me her services nor try and scare me into hiring a lawyer at all. she was very nice and helpful.
