Am very sorry to hear this,also its good you did t hide any information bcos if you did,it would have been worse, just move on and get married and fill for i130 for him and the children u would be approved this time

The turnaround time could be 24-26 mths, after U close

this case go get marry and file I 130,its gets approved

go to nVC after checks & payment interview date is

issued, that's the processed.

They did not seem to think to relationship is bonafide, so

get marry and remember all questions asked at this interview

has the answers on file ...keep that in mind

Meaning the turnaround time for I-130 is 7-9 months. As far as NVC it depends. I have seen where others once they receive their NO2 they are already prepared and have all of their paper work ready to go, and then their are some that are not prepared. No two case are the same. I saw a post from one of our Haiti members whose I-130 was approve in 2 months and then sent to NVC for processing (see post below). Therefore always think positive, but most importantly know that you do have another chance.

Hello everybody I'am an Newbie here ,I filed a petition for my wife on september 23rd 2013 my case was assigned to VSC my Pd is Sept. 30 .I received my NOA 2 this week. Now i have a few questions. I was very lucky to have my case approved in VSC so fastdancin5hr.gif

I heard the next step is NVC

1- Does Uscis will transfer my case to NVC even my PD is not current ?

2- (If 1 is yes) Does Nvc will start the process or it will wait until my PD is current?

No, that's not true at all. The turnaround time for the I-130 is 7-9 months at the USCIS stage and another 5-6 months from USCIS to approval at the embassy. So a total of 12 to 15 months. It's terrible right now, but it is what it is.

The reason why I asked. I was advised by many different people on this site, also from attorneys I've call to find out what was the quickest way to terminate my K1 visa after a refusal. I was advise to write a letter to USCIS giving details on why I wanted to terminate the K1 Visa which I did. I later received a response (letter in the mail) stating that they were forwarding my letter to the Haitian Embassy for case termination. weeks later I received an email from the Haitian Embassy stating once I married the beneficiary my K1 visa category was automatically terminated and I was free to apply for the I-130 for my spouse and stepson.

Yes it is by choice plus i wanted the case close. I thought one had to wait until its close to move forward. And of course fiance plays a big part.

I'm trying to help the OP realize that it's a long road and not get their hopes up with a process that right now is taking much much longer than the K-1 process.

I will say this for the last time. approval for form i-130 7-9 month. I am strickly talking about the I-130 not NVC or Embassy Interview....... What ever the case I am happy to know they have a chance no matter what time from we are both talking about....

It's been a while since I've entered any updates and I apologize. Just wanted to let you all know that the process has been very long for me, I was expecting this to just take a few months however, it took longer than I expected and I faced several obstacles along the way. My finance finally interviewed yesterday and was "not approved". He was asked…

  1. When did we start dating?
  2. When are the children coming?
  3. Why was my last visit to Haiti in 2012?

In 2012 I lost my job but still managed to go to Haiti twice that year. In 2013 due to financial hardship and the issues we were having with his passport I decided not to go in order to cut back on expenses. He has 3 children and we filed for them as well. He was asked question #2 twice. I found that to be kind of odd, why would the immigration officer ask him the same question twice? My fiancé’s response to the question was because I am the one handling everything he and I agreed due to financial reasons that the children would follow later. This is exactly what we discussed.

I contacted the Embassy and spoke to a gentleman who asked me over the phone when did my fiancé and I meet? I answered the question and was asked the question again. I also found that to be kind of strange. Was I being interviewed over the phone? He then went on to say that there wasn't enough proof. And once a decision is made it is final and cannot be over turned not even by a lawyer. He mentioned something about the children and then said to me I should have applied for my fiancé only and if we were married then I would have been called in for an interview. I was actually waiting on standby just in case I was called in to come in for an interview. I explained to the gentleman, on the application whether or not the applicant or the petitioner has children is one of the many questions that is asked on the forms. It was answered truthfully and it was also indicated that the children would not travel with their father, however at a later date. For some reason I really feel like the fact that the children were on the application was the reason for the denial. The youngest was born in 2008 and we became in couple in 2011, based on my conversation with the gentleman who answered the phone he said without really implying that I should have only applied for Jean Eddy. I love his children as my own, we’re a family and I felt that adding them to the application was required and the best thing to do. They are still very young children and they would have certainly had a brighter future here.

The gentleman was very helpful I don’t know if anyone else has experienced this when calling the Embassy, but they are not that friendliest and they have no patience. He advised that I come to Haiti and marry my fiancé then apply for the I-130, can someone please advise me on the process and the turnaround time after I apply? I have some comfort in knowing that we do have another chance still I was expecting him to be here in another 2-3 days. I will be traveling to Haiti next month. Since the K-1 was denied will I receive anything regarding the decision that was made by mail or email?

Where did I indicate I didn't know what you were talking about?? I'm trying to let the OP know what the total time from NOA1 to POE is for the spousal visa. I realize you were just pointing out the I-130 and didn't say otherwise. No need to get frustrated.

Not getting frustrated now getting worried, because you said once it's reaching NVC stages it is taking up to 5 months. Is this for real????
