It's been a while since I've entered any updates and I apologize. Just wanted to let you all know that the process has been very long for me, I was expecting this to just take a few months however, it took longer than I expected and I faced several obstacles along the way. My finance finally interviewed yesterday and was "not approved". He was asked…

  1. When did we start dating?
  2. When are the children coming?
  3. Why was my last visit to Haiti in 2012?

In 2012 I lost my job but still managed to go to Haiti twice that year. In 2013 due to financial hardship and the issues we were having with his passport I decided not to go in order to cut back on expenses. He has 3 children and we filed for them as well. He was asked question #2 twice. I found that to be kind of odd, why would the immigration officer ask him the same question twice? My fiancé’s response to the question was because I am the one handling everything he and I agreed due to financial reasons that the children would follow later. This is exactly what we discussed.

I contacted the Embassy and spoke to a gentleman who asked me over the phone when did my fiancé and I meet? I answered the question and was asked the question again. I also found that to be kind of strange. Was I being interviewed over the phone? He then went on to say that there wasn't enough proof. And once a decision is made it is final and cannot be over turned not even by a lawyer. He mentioned something about the children and then said to me I should have applied for my fiancé only and if we were married then I would have been called in for an interview. I was actually waiting on standby just in case I was called in to come in for an interview. I explained to the gentleman, on the application whether or not the applicant or the petitioner has children is one of the many questions that is asked on the forms. It was answered truthfully and it was also indicated that the children would not travel with their father, however at a later date. For some reason I really feel like the fact that the children were on the application was the reason for the denial. The youngest was born in 2008 and we became in couple in 2011, based on my conversation with the gentleman who answered the phone he said without really implying that I should have only applied for Jean Eddy. I love his children as my own, we’re a family and I felt that adding them to the application was required and the best thing to do. They are still very young children and they would have certainly had a brighter future here.

The gentleman was very helpful I don’t know if anyone else has experienced this when calling the Embassy, but they are not that friendliest and they have no patience. He advised that I come to Haiti and marry my fiancé then apply for the I-130, can someone please advise me on the process and the turnaround time after I apply? I have some comfort in knowing that we do have another chance still I was expecting him to be here in another 2-3 days. I will be traveling to Haiti next month. Since the K-1 was denied will I receive anything regarding the decision that was made by mail or email?

Oh wow! So I am truly convinced that it had something to do with the children. It's very contradicting, what's the point of asking if the petitioner/beneficiary has children if it will some how affection the decision. That is crazy!!!

It sure does suck!! I see that I am not the only one with similiar situation. On the application whether or not the applicant or the petitioner has any children is one of the many questions that is. It was answered truthfully and it was also indicated that the children would not travel with their father, however at a later date. What about if I had not disclosed that piece of information. There are two options to choose from will the children travel with parent or will they come at a later date. There is no option that states that the petitioner will not file for the children.

My husband is a Haitian citizen and lives in DR. I'm still getting my paper work together to send out the i-130. But as we did our research and it was better to do it as a spouse. I recommend you guys get married and file as husband. God luck and may God direct your steps, he really is in control of every situation. If you are a believer seek his guidance. He wont let you down! :)

Sorry to hear that. You can apply for the I-130 once you marry him, and if you will be applying for the children as well; however you must apply one I-130 per person which is $420 for each I-130 application you submit. The turn around time is about 7-9 months, so at least you have another chance. Good Luck

Am sorry you were denied. I see you mentioned last year. Was it by choice to wait so long before marrying him and starting the I-130 process sooner?

The turn around time is about 7-9 months, so at least you have another chance. Good Luck

No, that's not true at all. The turnaround time for the I-130 is 7-9 months at the USCIS stage and another 5-6 months from USCIS to approval at the embassy. So a total of 12 to 15 months. It's terrible right now, but it is what it is.
