Up to when k1 can file AOS and can K2 apply for US passport

My friends fiance now his wife entered with a K1 visa with their 6 yr old son.

They tried to get the K2's SSN but SSN said they cannot issue him SSN. He wanted to apply for his sons medical coverage already and cannot do so without the SSN.

Since the son is under 18 and being my friend is a USC, can he apply for his sons US passport? But then again, US Passport requires SSN that he doesn't have.

up to when do they need to file for the adjustment of status? They are thinking of applying for the sons US passport so he doesnt need to be included on the AOS or does he need to be added first then apply for the US passport after?

Timeline

Did they apply for CRBA before and it was denied? If it was denied, the child must have LPR status, therefore should do AOS. What's the reason for SSA not to issue a number?

Not always. There are circumstances when the USC petitioner is also the bio parent but didn't meet the CRBA requirements, therefore making the child disqualified to claim US citizenship and must have a visa to enter the US.

No, then the parent would file a I-130 for their own kid, and enter on an immigrant visa.

Here's an answer to your question:

:: For K2, K3, K4 Visa Holders ::

As a holder of a K2, K3 or K4 visa you must first have an EAD from the USCIS. You will be required to

show this to the SSA agency to be eligible to receive a SSN.

To apply for a SSN you will need to go to your local SSA office and bring:

1.
The SS-5 form you downloaded and filled out (they have some at the office if you forget).
2.
Passport (with the K-2, K-3, or K-4 Visa in it)
3.
your valid I-94: Electronic I-94 Copy; or (for older entries) an original (and bring a front/backside copy) of a valid paper I-94
4.
another form of valid ID (as defined in the SS-5 instructions)
5.
A valid EAD

Only persons age 12 and older must apply in person. A derivitive visa beneficiary (K2 for example) may

elect to have their parent (the K1 for example) apply on their behalf (they will still need all the required

documents). The SSA will most likely need to verify the validity of the EAD and will make a copy to send to the USCIS as part of the SSN processing. Once they verify the EAD you will receive your SSN card in the mail.

You can check on the status of your SSN application and/or often get the SSN in advance by returning in person to the SSA office. If you need your SSN before it arrives in the mail you may ask them for an SSA-7028, Notice to Third Party of Social Security Number Assignments, to be sent to your employer or other interested third party once a SSN has been assigned. Your card, when you receive it, will be marked with the words "VALID FOR WORK ONLY WITH INS AUTHORIZATION" indicating to an employer that you must also have an unexpired EAD to be eligible to work.

For K1, tell her not to wait till 14 days prior

to the expiration on your I-94, or she won't be allowed to get SSN.

They said they need a DHS paper. we assumed that is the I-94 so they did but they still was refused to get one.

They didn't apply for CRBA because they did the k1/k2 instead. the son was born before my friend became USC

Yes! EAD application is free if filed together with AOS. in our case, and most of the people that currently filed the same date with us. It took a little over 2 months while our AOS took almost 5 months to complete.

That must be your Insurance company. My Wife (K1), once she got married to me, he and the 4 girls automatically got insurance through my employer without SSN#'s.

I would check with your employer about that.

Hi there - I applied for my SSN after our wedding and after filing our marriage certificate to the city hall... I brought and presented the marriage certificate, passport with the entry visa stamp and the I-94.. I received my SSN a week after with the "valid for work with authorization from DHS.. So i was able to apply for jobs long before my work permit was even submitted/processed. I just started working now and I am scheduled to visit DHS office in OKC for finger print and photo for work permit application this thursday...

I brought and presented the marriage certificate, passport with the entry visa stamp and the I-94.. I received my SSN a week after with the "valid for work with authorization from DHS.. So i was able to apply for jobs long before my work permit was even submitted/processed. I just started working now and I am scheduled to visit DHS office in OKC for finger print and photo for work permit application this thursday...

An SSN alone does not allow you to work. You must have the SSN and the EAD, which is the DHS authorization mentioned on your social security card. If you started working without getting your EAD first, then you are working illegally. Your employer should not have hired you without one. They could have given you a job offer, and you could request an expedite of your EAD based on the job offer, but you cannot legally start working without it first.

My SSN has the notation of valid for work with dhs authorization on it. meaning I am eligible to work.. My employer ran a background check on me and it was fine..do u really think a corporate employer will hire an illegal worker without their SSN?
