I-129F , couple of questions

Hello,

I am a US Citizen living in the United States. I met my Fiance on a 10 day trip to Ireland in October 2013. She is a lithuanian citizen, but has been living in Ireland since 2008. She is currently in the US visiting under the Visa Waiver Program. She has been here for four weeks and will be returning home in 2 weeks on the 19th of February. We have started to fill out the I-129F but have a few questions. I have searched for answers but am still confused on a few things.

  • 3. Alien Registration Number? I am a US citizen so I don't have one. Leave it blank or write none?
  • 13.d. I was born in the United States so for 13a I selected I acquired my citizenship through birth in the US. But 13d asks if I have obtained a certificate of naturalization or a certificate of citizenship in my name. If I was born in the US to two US citizens the answer to 13d is no, correct?
  • 2.c. If my Fiance does not have a middle name should I leave this blank or put None?
  • 3.b.-3.i. This question asks for Fiances mailing address. The format for an address in Ireland is

House # Street Name

Town/City

County

Country

I am not sure how to put this into the 129F form. They do not have states or zip or postal codes. Where do I put the county information? Also they have four provinces in Ireland but they don't use the province when sending mail.

  • 15.a.-15.h. If your Fiance is currently in the United States complete the following: - Do I answer this if she is here but is returning in two weeks? Or are they asking if she is here long term?

15a He or she last arrived as a: _________. - Do I put visitor? Tourist?

15b I-94 Arrival/Departure Record Number _____. - What is this?

15d Date of authorized stay expired or will expire as shown on I94 or I95 ______. - She doesnt have a I94 or I95 as far as I know.

15f Travel Document Number ______. - What is this? I dont think she has this either.

  • 36.a.-36.b. Your fiance will apply for a visa abroad at the American embassy or consulate at: _________.

She is a lithuanian citizen living in Ireland. Should I put the US embassy/consulate in Dublin, Ireland closest to her residence?

  • Last question. My fiance currently has an apartment in Dublin but may move back home (30 minutes away) with family to save money for when she travels back to the US. I put her mailing address as her family's home but should I put her address abroad as her family's home as well just in case she does move back home?

Sorry for all the questions but after much reading I know I should make sure everything is perfect to avoid delays before I send everything out. Thank you in advance for your help.

Hi! I'm going to try to answer since our situation seems similar (I was also in the States while filing the form) Our case was sent to California Service Center and approved very quickly so hopefully we did things right! However, don't just take my word for it, we might have done something wrong and they overlooked it... I'm just giving you my honest opinion.

We left it blank. My fiance is also a US citizen by birth so this does not apply to you

My gosh, I just noticed we left 13d blank!!! I guess they didn't notice :-P I would cross NO then

In Spain we do not have middle names so I left it blank (I didn't want them to think that my middle name is None!) What I did is attach a post it on top of the question explaining that in Spain we have ONE first name, NO middle name and TWO last names (the first is the paternal last name and the second is the maternal one) I signed the post it.

3.b.-3.i. This question asks for Fiances mailing address.

In Spain it's different but here's what I could do: if they don't use provinces, then just put the county name where it says province. Again, your fiancee can put a post it explaining how addresses work in Ireland and sign it.

I was also visiting my fiance so I did the following: in 15a I wrote VISITOR. Nothing on 15b as it no longer applies (since the ESTA system, there's no I-94 any more) 15d you have to look at the stamp in her passport; this is not the day she's leaving but the 90 days that the ESTA system allows you to stay in the States. I left 15f, travel document number, blank. What I did (surprise! :-P) was attach a signed post it saying that: form I-94 no longer exists and that I attached a copy of the official website http://www.cbp.gov/xp/cgov/travel/id_visa/i-94_instructions/i94_rollout.xml and highlighted the part where it says Foreign visitors to the U.S. arriving via air or sea no longer need to complete paper Customs and Border Protection Form I-94 or I-94W

I also included: a copy of my flying itinerary highlighting the date of departure, a photocopy of my passport page where the stamp is (where it states the date when you have to leave) and a photocopy of my ESTA authorization number, highlighting the number. I don't know about Ireland but in Spain we need to fill in the ESTA form and print the page where there's a number and it says "approved". We have to bring this with us in order to be allowed entry in the US as a visitor or tourist.

Since it says consulate, I wrote Barcelona, which is where I live. However, later on I saw that in Spain they only give visa interviews at the embassy in Madrid so I'll have to go there. If she's living in Ireland then she'll have to go to the embassy in Ireland (I'm guessing it's in Dublin as it's usually in the capital and there is only one embassy) But not sure how it works in Ireland! You could start a post with this question in the Europe subforum and ask other people from Ireland.

Last question. My fiance currently has an apartment in Dublin but may move back home (30 minutes away) with family to save money for when she travels back to the US. For me the most important thing is to put an address that won't change as this may be a problem. Since both my fiance and I might move, he put his mom's address and I put my parents'. Even if he's not there or I'm not there, our parents can get the letters for us. None of them are going anywhere so it's safer to put their addresses than ours. My fiance is actually at his mom's until we find and apartment and so am I (at my parents') until I figure out what to do next so it works out but even if I move I'm leaving my parent's address as my home base :-)

I-129F NOA1: Jan 3rd 2014 (notification received by e-mail and text message; hard copy received on Jan 10th)
I-129F NOA2: Jan 27th 2014 (notification through USCIS mailing list; hard copy received on Feb 3rd)
NVC Received: Feb 07th 2014 (verified through phone call; no notification received)
NVC Left: Feb 11th 2014 (CEAC status changed to "in transit"; called NVC to verify)
Processed at Consulate: Feb 20th 2014 (I sent the embassy an e-mail on Feb 18th and they replied Feb 21st saying that they had received my case the day before)
Package 3 received: Feb 21st 2014 (sent by embassy through e-mail attachment; it was a Word document; they usually send it through regular mail)
Package 3 sent: Feb 24th 2014 (received at the consulate Feb 25th; I know this because I sent a certified letter with online tracking)
Interview date: April 30th 2014 (notification received by e-mail on March 21st; hard copy received on March 26th)

  • 13.d. I was born in the United States so for 13a I selected I acquired my citizenship through birth in the US. But 13d asks if I have obtained a certificate of naturalization or a certificate of citizenship in my name. If I was born in the US to two US citizens the answer to 13d is no, correct? - 13a. - Put Birth in US. 13d. - Put NO.
  • 2.c. If my Fiance does not have a middle name should I leave this blank or put None? - If you read the instruction to I-129F attentive, they say to leave blank questions that do not apply for you. (We had fields that do not apply for us blank, and we were fine. BUT IN G-325A there are questions where they ask IF NONE STATE NONE, so be attentive!!!)
  • 3.b.-3.i. This question asks for Fiances mailing address. The format for an address in Ireland is

Name of fiance.

Street number and name (I bet in Ireland they do have str name and her apartment or house has a number...)

City or Town (you put where she lives)

State (leave blank, we in Ukraine also do not have states but regions, so we left it blank)

Zip Code (we also do not have, so we left blank)

Postal code (each place has it, so google if you dont know her area postal code!!)

Province (i suggest you put the County she lives in, we did same with ours, we puted region where I live).

Country (put Ireland).

Or are they asking if she is here long term? - they ask if CURRENTLY she is in the US, so if she goes back soon, and you file form AFTER she leaves US, i recommend to put NO, but if u file form while she is in the US, than i guess you should answer the rest of questions.

15a He or she last arrived as a: _________. - Do I put visitor? Tourist? - If you in question 15. state she is no longer in the US, there is no need to answer the rest, but if you will be filling I-129F while she IS IN THE USA that you give all information as stated in her visa, YOU SAY THE TRUTH.

15b I-94 Arrival/Departure Record Number _____. - What is this? - read about I-94 over forum or in Customs http://www.cbp.gov/xp/cgov/travel/id_visa/i-94_instructions/

15d Date of authorized stay expired or will expire as shown on I94 or I95 ______. - She doesnt have a I94 or I95 as far as I know.

15f Travel Document Number ______. - What is this? I dont think she has this either. - travel document is her PASSPORT.

She is a lithuanian citizen living in Ireland. Should I put the US embassy/consulate in Dublin, Ireland closest to her residence? - as far as i know, if she is legally residing in Ireland you may put Ireland, but double check this, cos she will need to go for medical exam after you got approved, i am not sure if in Ireland they attend non-citizents (in case if she is non citizen)....please develop this topic yourself to be sure you put all correctly.

  • Last question. My fiance currently has an apartment in Dublin but may move back home (30 minutes away) with family to save money for when she travels back to the US. I put her mailing address as her family's home but should I put her address abroad as her family's home as well just in case she does move back home? - i recommend to put the same address in all fields (ATTENTION she is also filing G-235A where they ask address, so make sure all addresses are same!!!!), if she will be at her parents house living, than put it. Do not complicate things where they may be solved easy. First decide where she will finally stay, and state the same address.
