Lawyer says I need to file i130 for AOS??

Hi guys,

Just in the process of gathering docs for AOS. I entered the US on a K1 visa and married my fiance within a month of entering. Since my husband is military, we are able to have a lawyer help us with the process for free. So far, she has been helpful but there is one thing I don't understand. She says we need to file the i130 with our AOS if we didn't previously file. I am confused because I thought that the I130 is for USC who want to bring their spouses into the US. Can anyone confirm this? Do I need to file the i130 or is my lawyer mistaken? Thanks!!

Your lawyer is WRONG. Do not do anything else with the lawyer. Read the I-485 instructions and it will become painfully clear. You will be applying for I-485 based on approved I--129F and subsequent marriage to the petitioner within 90 days of entering the US, choice C in part 2.

Have you found the appropriate VJ guide?

2/06/13: APPROVED!
