Hello all. My wife and I are working on her AOS and have a few questions.
1) the i-864 requests tax information for the most recent year. Considering that it is tax season, should we wait until 2013 taxes are filed or can I go ahead and submit 2012 for the most recent year?
2) The walk-through for the i-485 says that that the fee for the i-485 includes the fee for the i-131 and 765, but later says to include payments as indicated on the forms. Will submitting these forms increase the amount of money that I will have to pay for the 485, or does the 485 cost the same regardless of whether or not I submit these documents as well.
3) Should we file the i-131 "just in case" even though my wife does not have concrete plans to travel?

1. Up until April 15th you can just supply the 2012 transcript

2. I131 & I765 have no fee when submitted as part of an I485 application, whether you file at the same time or later in the process. However you should file at the same time so the EAD can be issued quicker.

3. Yes, you should always file the I-131 as you never know what might happen in your wife's home country necessitating her going back

Wow, thanks for the quick answers. So I should check the box that says "I have filed a Federal tax return or each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year" and then include the 1040 for 2012?

My annual income increased substantially in 2013. Should I include a letter from my employer as proof of my current income?

In the I-131, what should we put for date of intended departure and purpose of trip?

You would be better off downloading the full transcript from the IRS, you can use the return but you have to also provide copies of the W2's, previously that could be quicker for some but now you can just download & print your IRS tax transcripts so it is a no brainer.

For your 2013 income you can attach the letter from your employer along with some of your most recent pay slips and/or file your taxes so you can include the tax return + W2's.

You can just leave that section of the I-131 blank or put unknown.
