Hello,

My conditional green card expired on mid august, so I guess we have to apply during may to have the conditions lifted... Do you know how long it takes (with INS) to receive a new permanent green card...

My problem is that my daugther green card expired also aug 15th, and she will be in her home country during summer vacation... So does she need to get back before aug 15th, or there is some possiblity to have prolongatin of her green card...

August 19th 2004 - Successful AOS interview

March 30th 2006 - Sent our I-751 applications

June 16th, 2006 - Received a letter with 1 year extention for our Green cards

JULY 16th, 2006 - OUR BABY SON IS BORN WE ALL ARE SO HAPPY !!!!

August 19th, 2006 - Received 10 year Green cards

Cat, are you saying your conditional gc already expired last Aug 15, 2005? Or are you saying that it will expire on Aug. 15, 2006?

If both your conditional GCs are expiring in Aug 2006, then both of you should submit your application for removal of conditions 90 days before the expiration date. Unfortunately, there is no extension of conditional GC expiration dates. As soon as you get the NOAs for your application, you will take them + your GCs to your D.O. where they will take your GCs and stamp your passports. Hopefully, you will get this all done before your daughter has to leave for her trip.

If both your conditional GCs are expiring in Aug 2006, then both of you should submit your application for removal of conditions 90 days before the expiration date. The NOA does extend the Permanent Resident status for one year. That NOA, and the expired Green Card, are valid travel documents---no stamp required and many DOs will not issue a stamp for the passport.

I agree tho, if they apply at the early end of their 90 day window, they should have a NOA in plenty of time to travel.

Is it possible to send the application before 90 days... exemple, our GCs expire on Aug 16th, 2006 so I normally should ti send application on May 16th... If it possible to send in April or May 1st?

Unfotunately, "no can do" on filing early. If it is submitted prior to 90 days, the petition will be returned. :(

Unfotunately, "no can do" on filing early. If it is submitted prior to 90 days, the petition will be returned. :(

Correct on the 90 days part, and also note that 90 days isn't the same as 3 months. 90 days ahead of Aug 16 is May 18, not May 16 as suggested in that post. Remember that May 31 and July 31 are included in that window. The window opens 90 days before GC expiration, and closes on the GC expiration date.

thank you very much... I have checked, on my stamp in passport the day of interview, they put expired on Aud 18th... But my GC com with exp date on Aug 19th. When should I send my application? I think I will send it on May 23rd... it will be about 88 days before expiration. Is it OK?

When after that I can wait my NOA?

If I undersand after that I can travel and work etc for 1 year right?
