Hey everyone :)

I am from England and my Girlfriend lives in Virginia. We met in Europe and have been together for couple years.

I am going to USA soon to try get a company to sponsor me to get h1-b but I'm feeling like this is a long long shot. I have a degree in IT and 2 years work experience.

I couldn't find any current threads regarding marriage. How long would it take to get the green card from day of posting papers? She lives in Virginia.

I just want to be with her so bad and I'm not sure what route to go down.

Thanks for any help.

Ed

You may as well give up on the notion of getting a H1B, at the very earliest it wouldn't be until October 2015. Your best option would be a green card via marriage, the proper way to do that would be to go through the process of getting a K1 visa through your consulate, then get married in the US and AOS with an I-485 but what all the cool kids seem to be doing is entering the US on the VWP with absolutely no intention of getting married but on a whim decide to tie the knot and then go the I130 + I485 AOS route.

Its illegal to enter the USA with the intention to immigrate. They would deny you upon entry and if you lie and are caught in that lie, you can be banned for a lifetime. I suggest being legal with either the quickest but more expensive route called the K1. The less quick but cheaper better visa route is to be married and go on the cr1 path. Look at the comparison chart on VJ (ignore the bit about not visiting, because you can if you have an ESTA) and decide as a couple what would be best.

In April 2014, you can apply for the H1-b visas that becomes available that becomes available on Oct 1, 2014.

The yearly allotment of H-1b visas can run out in mere days.

It's unlikely that you will find a US employer in one and a half months who will have your paperwork ready to file in time. Best of luck if you can.

A K-1 fiancé visa seems like your best option.

H1b is dual intent.

First find your employer.

Not sure what you going on about visa fraud

Thanks for all your help smile.png

A lot of new people on VJ think that it is perfectly acceptable to travel to the US with plans to marry and adjust status. This is the visa fraud. You already mentioned going to the US and that you can't stand to be apart. We are trying to help you do this legally.

Your plan of the H1b is a long shot at best, why not file the K1 now and get this ball rolling? You may still visit your girlfriend during the process

good luck
