Yes I sent plain tickets as well as copies of 2 Visa stamps (country entries)

Do I reapply or appeal Im just soooo upset right now, I can't think straight.......

Plane tickets are not primary evidence, only the boarding passes are. However the visa stamps in your passport are good primary evidence of meeting. Its really hard to say why your petition was denied. Just wait for the denial letter, and once you learn why you were denied you can try to correct it and re-file.

So whats best and faster? Appeal or Reapply?

Nobody can answer this competently without knowing why you were denied.

Not every denial can be appealed.

If you screwed up and not the US government, then there is nothing you can appeal.

If the US government made a judgment that you think is wrong and there is a basis in the law for redress, then you can appeal.

you would think so, but that uscis status portal thingie is not reliable.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I'm with this:

You would need to wait for the hard copy of the denial notice to see whether it would be best to reapply from scratch or appeal. 90% of the time it's best just to resubmit, since (i) you need to show it was USCIS' error, not yours, to have any chance of success in an appeal, and (ii) it's usually faster just to reapply, since an appeal would take around a year to do.


Wait for your denial notice so you learn why you were denied without any RFE. You said you checked almost everyday and there was never an update between initial review and your denial notification, right? I'm assuming you get at least email notification when your case is updated, and you are sure that there was never a notification that a RFE was sent.

I couldn't find an old post where people discussed the reason of a denial without any RFE and at the USCIS stage. I'd look around the forum while you wait for your actual denial notice on the mail.

Sorry this happened to you. Hope there is some work around at the end.

It will depend on why it was denied.

K1 - Filed March 2011

- Denied March 13, 2012

- Placed in AP March 14,2012

- Sent back to USCIS November 2012

- Expired March 2013

Just to verify because many get this wrong. Are you actually registered on the USCIS site? So many say its been initial review for months and they never registered.

So just wanted to double check that. Might be why you may have messed a notice from them. If not registered you won't get email or text going forward.

Did you add all the requiered documents?
I see you added pictures, boarding passes and phone records but what about the petitioner's Birthcertificate or every page of the passport (with hardcover), a letter of intent and did you had the original signatures on your documents? (petitioner's original signature on : cover letter, last page of I-129F, G325, letter of intent --- foreign fiancé signature on : G325 + letter of intent) <-- I hope I didn't forget anything.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I have no idea what it might be, but I just did not hear enough evidence sent with the K-1. Airline tickets are not good enough, it takes "boarding passes" pictures with times, dates, and who is in them and where written on the back in pencil, hotel receipts, food receipts, letters between the two of you, pledging your un-dying love and intesnt to marry, handwrittn.,.,I could go on and on, .,.,.tax returns, proof of job, income, a letter from your employer supporting your quest, alll of this would make your case better, I think..,.,

I hope it all is just a mistake, but just from what you said, I would think you needed to send much, much more evidence.

I hope it all works out for you, and is just a mistake, but iF you have to re-apply, seek expert advice on this site, for what to submit.

We have been waiting since August 7th for a decision on our K1 Visa petition. After my processing time had passed I had made a Service Request, in January. And I just got an email that it has been DENIED. The letter will come by mail with the reason what the problem is???? WHAT SHOULD WE DO???? PLEASE HELP????????? RE-APPLY OR APPEAL???? OR WHAT? PLEASE HELP!!!!

Most of what you mentioned here is not needed for the petition to be approved. You must only prove that you have met in person within the past 2 years, you must be free to marry, you must show the petitioner is a US citizen, and you must include letters of intent to marry. The lack of handwritten letters, tax returns, job proof, a letter from your employer, income proof in the petition package would not be a reason for denial of the petition. Income proof comes later in the process during the actual visa application when the I-134 is submitted.
