We have been waiting since August 7th for a decision on our K1 Visa petition. After my processing time had passed I had made a Service Request, in January. And I just got an email that it has been DENIED. The letter will come by mail with the reason what the problem is???? WHAT SHOULD WE DO???? PLEASE HELP????????? RE-APPLY OR APPEAL???? OR WHAT? PLEASE HELP!!!!

You mean your petition was denied? Did you have an interview yet?

Did you receive an RFE?

Did you send only the I-129F and nothing else?

Hi my Petition was Denied, I don't know the reason yet, the letter will tell me why...... But The first time I spoke to level 2 officer he said there is an RFE in his computer, but it was never sent to me. The second time I called for more information, the Officer said there is no RFE in the computer. and the decision will come within 15 day-30 days. What do I do,,,,,?????????????? Reapply or Appeal??? What is better and Faster way? Non of us were convicted nor arrested in the past!!!

call back, talk to an ISO,

and

ask if any 'returned mail pieces' on you.

Then ask what they are.

then go over yer address again with the ISO, asking to have the returned mail pieces resent.

I'm betting the RFE nixed back from a USPS mailing, so you never saw it. Interesting through - that is supposed to show up in that online status portal if'n an RFE was issued. Not what it was, just that it was.

You might have other movement available to you because of this.

Did you send boarding passes or stamps from your passport to prove you met within the 2 year time frame? Pictures do not prove you when you met, you need evidence that proves you met within the 2 years prior to filing the petition

Yes but I always checked the uscis case status site, like 20 times a day, and it always showed Initial Review. It would of showed me if RFE needed right????

Yes I sent plain tickets as well as copies of 2 Visa stamps (country entries)

Do I reapply or appeal Im just soooo upset right now, I can't think straight.......

You would need to wait for the hard copy of the denial notice to see whether it would be best to reapply from scratch or appeal. 90% of the time it's best just to resubmit, since (i) you need to show it was USCIS' error, not yours, to have any chance of success in an appeal, and (ii) it's usually faster just to reapply, since an appeal would take around a year to do.

I repeat: Did you send just the I-129F and nothing else?

Well my fiance didnt read the I-129f instructions, and he only sent on june 6 -2013 the form I-129 and the check.

I was waiting a deny, but for my surprice on september 15 they sent to him an intent to deny letter, asking for all the missing forms and evidence.

My fiance only had a month to answer, he sent all that they were asking for, the packet arrived 2 days before of the limit time.

And we were approved.

My interview is on march.

Everybody was telling here that we were going to be denied because only send the form and the check, but it wasnt like that.

You were fortunate, since that tends to be the exception rather than the rule; failing to completely follow a form's instructions is inviting USCIS to deny the application.

Yes I know we were lucky.

Everybody said when I posted about that , that it was a sure deny and refile.
