Introduction

One of the unprotected categories of speech consists of so called "fighting words," that is, words which are likely to make the person to whom they are addressed commit an act of violence. Fighting words receive no First Amendment protection, because, like other unprotected categories (i.e. defamation, obscenity, etc.) They are not normally part of any dialogue or exposition of ideas. But, the Supreme Court today keeps this exclusion within narrow limits.

The fighting words doctrine originated in Chaplinsky v. New Hampshire, 315 U.S. 568 (1942). The Chaplinsky ruling defined fighting words rather broadly. This doctrine included words which are likely to incite an immediate fight and words which inflict injury.

The Court realized soon after Chaplinsky, "that giving a broad scope to the fighting words doctrine would lead to the depletion of important First Amendment protections" (Emanuel 458). Therefore, the fighting words doctrine has since been limited in many ways.

While the "fighting words doctrine" does indeed exist, it would not excuse the reaction of West, but any man has a moral right to react to such a statement to his wife.

I like it when certain menfolk on here call me "dear." It has a such a cosy, grandfatherly feel to it that isn't creepy in the least.

It's like this, Danno... if you have never met my mom, and you talk shite about her, it means just about as much as if you were to talk ####### about Arpita Pichai of India. Exactly nothing, since you don't know them. Why would I get upset and all in a tizzy due to your ignorance? It's just a reflection on YOU, not my mom.

Now, if you know my mom, and are talking shite about her, and take it too far (call her a cheap ####### as you said above), expect to walk away from the convo with a bloody lip, minimum.

Just to clarify, no, I don't know your mom and my reference to a slur was made.... not even hypothetically at anyone specific but rather in the part of my post about men in general.

Because it takes a bigger person to walk away. There's been plenty of times where I've had to do it, it's probably why I'm still here today. Pride can get you killed. And for what? Just to "win" the argument?
