I wasn't trying to imply that he was within his rights to assault him. But some people say sh*t and they just have it coming to them. Don't really feel bad for him.

If an armed man shoots someone over one punch to the face, then the armed man has some serious issues.

I'm not so sure he didn't have a right.

There is a principle legally known as "fighting words" which allows a person to respond to such an over the top insult.

It would be interesting to know if the "teen" was 19 or 13.. if it were a little kid or a man-sized azz.

It sounds to me like this is a "teachable moment" for Kanye, perhaps it is time for him to get off the tour-schedule mod of travel and visit the rest of the world in a more serious way, he might find comparatively speaking, a Black man has it pretty good here...... warts and all.

"Provocation" is a legal term and hasn't been adopted as a defense or mitigating factor in all states.

"Fightin' words" ain't a legal term and you'd be laughed out of court even in BFE, AL.

Your legal tip of the day.

The “Bound 2” rapper won’t face criminal prosecution in the alleged smackdown of an 18-year-old male who hurled the N-world at Kim Kardashian in Beverly Hills two weeks ago, a Los Angeles District Attorney’s Office spokesman said Friday.

If you scroll down, they show a picture of the dude, he's an average size man. He didn't have the right to assault him, but, as I stated before, you insulting someone's SO, you can expect something in return. Personally, I think the dude did this to get a payday.($250.000 to be exact if I remember correctly)

Introduction

One of the unprotected categories of speech consists of so called "fighting words," that is, words which are likely to make the person to whom they are addressed commit an act of violence. Fighting words receive no First Amendment protection, because, like other unprotected categories (i.e. defamation, obscenity, etc.) They are not normally part of any dialogue or exposition of ideas. But, the Supreme Court today keeps this exclusion within narrow limits.

The fighting words doctrine originated in Chaplinsky v. New Hampshire, 315 U.S. 568 (1942). The Chaplinsky ruling defined fighting words rather broadly. This doctrine included words which are likely to incite an immediate fight and words which inflict injury.

The Court realized soon after Chaplinsky, "that giving a broad scope to the fighting words doctrine would lead to the depletion of important First Amendment protections" (Emanuel 458). Therefore, the fighting words doctrine has since been limited in many ways.

-------------

While the "fighting words doctrine" does indeed exist, it would not excuse the reaction of West, but any man has a moral right to react to such a statement to his wife.

In fact I would say a duty.

What is jacked with this picture?

On the other hand....

Probably to do other wise would have cost him more money.

N!gger is just a word. As such, it carries no physical pain when it is used, no bruising, no broken bones. That's for sticks and stones, remember? Therefore he had no legal right to pop the kid (though I can easily see why he did so. Mighta even gave him a high-five if I'd have been there)

He could have countered with something like "This black man she's with makes more in a year than you'll make your entire, miserable, racist life." and walked away. Or at least I say that from the comfort of my bedroom, not in the heat of the moment.

Neger, negre, negro, niger n!gger... all words that mean black. The undesirable meaning is either in the words as they are hurled, or felt (imagined?) by the receiver.

Kind of like when I am called a cracka or cracker. Yeah, I know, Jinx postulates it comes from "whip cracker", some will say it's from the cracking of corn as food... but I think we all know it means whitey. I have even been labeled as "saltine". Gots NOTHING to do with the whips I have carried around all my life (none). Point is, I can choose to get all up in arms about being called a cracka, or I can just smile and be nice back to the attempted offense. Kinda depends on how it's put to me, I reckon.

That dude had a plan and it worked. He provoked a confrontation that ended in his physical assault and a payoff.

Query - who will complain if Kanye and Kim and North leave the USA?

or - which demographic of human clumpings will complain besides the IRS?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

It's also a word a lot of black people heard right before they were hung until they were dead. That's the reason a lot of the older generation refuses to use it. If you say in the house of my family, you'd get told a thing or two.

What most folks won't get, is that there's a simple reason that word or any other racial slur gets the reaction it does. If someone calls you something outlandish, you can ignore it because you know it isn't true. Or, you can rise above it in other ways. That word, or other slurs for black people constantly remind us of where we stand in the social order of this country. Same thing with hispanics or any other minority.

There isn't a word in the english language that you can attribute to white people to cause the same amount of pain that the N word, Illegal Alien, or any type of racial slur for other ethnicities causes. It's saying that no matter what you achieve, how far you've come, you'll always be that. It's attacking your very identity, your core being. That's why this dude used those words, anything less and it wouldn't have provoked Kayne as much.

I get pissed when anyone says the word around me, more so when it's a person of color, because they should know better.

I've been in situations where I've had some dude get kind of ignorant and my wife advised me to just let it be. She doesn't like violence so I respect her wishes. But in the case above, that dude was in Kim's face screaming that at her, she felt threatened, which is why Kayne ran in there and went at him. If he said that in passing and ran off, pretty sure Kayne would have let it go.
