We are currently getting everything together to send away our I-130.. My husband wrote a 4 1/4 page affidavit of bonafide, should he rewrite it to be shorter or does it really matter? He is separated from me and i told him over the phone how to write it, and he told me how long it is, I didnt know if they will say that is too long and not accept it..

Ok also.. My sister, her husband, and my husband are all in Mexico right now, they wrote affidavits for me.. should I have them all notarized, they said they were having a hard time with it, or do you think as long as I get a few notarized here in the USA it should be fine? My sister and husband in Mexico are the only 2 in my family who actually know my husband, my family here in the USA do not, the ones from the USA would only be able to say they know we communicate regularly via skype, phone, letters, etc. Also should be included is our affidavits is pretty much our only thing to show we are actually together. I don't have anything else, we don't share bank acc, no proof that I stayed with him(my name wasn't on any bills/lease), I don't have him send me money, etc. we don't share a property. So I am having a hard time with the bonafide part as it is.

To newbie,

I think 4 1/4 pages it is too long.

I would suggest you just one page (or two as maximum) for a bona fide marriage affidavit. Prefereably supported and signed for a third party.

It sounds very weird that your husband (I guess the USC) writes the affidavit on behalf of you (the spouse).

I would recommend you something like the following (this is my own sample, I already sent to USCIS):

CITY, STATE, COUNTRY

IN RE APPLICATION FOR A VISA FOR THE UNITED STATES OF AMERICA

Evidence in support of a bona fide marriage between Mr/Ms. USC NAME, petitioner, and Mr/Ms. SPOUSE NAME, beneficiary.

AFFIRMATION OF THIRD PARTY NAME

Third party name, being duly sworn, deposes and says:

  1. I am making this affirmation in connection with the application of Mr/Ms. BENEFICIARY NAME for a Visa for the United States of America. The contents of the affirmation are based on my own knowledge and are true.
  2. I was born on MONTH, DAY, YEAR in CITY, County, STATE, COUNTRY.
  3. My address is XXX Street, CITY, STATE, ZIP CODE, COUNTRY.
  4. USC NAME, the petitioner, is my TYPE OF CONNECTION (relative, friend, etc.).
  5. In MONTH, YEAR, I became aware of the relationship between petitioner and beneficiary.
  6. In MONTH YEAR, I first met BENEFICIARY in CITY and confirmed the relationship is genuine.
  7. I was one of the witnesses at USC NAME and BENEFICIARY NAME wedding on MONTH, DAY, YEAR which took place in CITY, STATE, COUNTRY,
  8. I have visited USC NAME and BENIFICIARY in their home in CITY STATE COUNTRY, and found them a very happy couple and obviously in love.
  9. I have personal knowledge of the bona fide of USC NAME and BENEFICIARY relationship. Their marriage is legitimate, viable, and not entered into for any immigration-related purpose.

Ok also.. There is no requirement to have such affidavits notarized.

Now the long answer.

Such affidavits carry little to zero weight and are not required in the first place. Furthermore, the other items you reference such as shared accounts, property, names on bills/lease, etc. are also not required nor would you be expected to have such things.

Evidence of time spent together in-person is always going to be your strongest evidence. This can range from pictures, copies of the passport page with entry/exit stamps, boarding passes, receipts, admission tickets, the list of possibilities is endless.

Also, copies Skype records, phone records, emails, letters, etc. etc. can be included and is stronger evidence in of themselves than someone writing that they know you communicate regularly via such communication records.

IMO, it doesn't really matter. If you want them to actually read it and for it to make any difference, I suggest editing it down to no more than two pages. It shoulld be about the evolution of your relationship.

Facts are cheap...knowing how to use them is precious...

I have pictures, mexico phone cards, phone call and text records, plane tickets, receipt of money he sent, receipt from usps from sending a letter/small package to him, letter from him and myself of our relationship and history, letters from brother in law, 2 sisters, and my mother, I will print skype call records (Thank you for that suggestion Ryan H) will you think them being under my sisters name because he uses her skype will be an issue? He doesnt have a laptop, email or skype so he just uses hers.

Other questions that have developed.

I have currently not filed yet, Hubby and I are having a very hard time dealing with being separate, because of this we are thinking about me sending in package and then me moving back to mexico and living there the whole time it processes. I worry that if I do this I will have had no job this whole year. I feel like I will some how get in trouble for being there for such a long time period, and that we will face problems of no income/no assets.

1. What would happen when it is time to file my affidavit of support?

2. Would it be better to go there, get a fm3, live there for the time needed and then file DCF I-130 from there? Or would it still face similar fate?

3. Would they be understanding to the fact that I had no job due to being there with them, and be ok with that so long as I have co-sponser?

My husband is in Spain residing with me (I am the beneficiary) and he is working here since August 2013.

Therefore, being abroad does not mean any handicap.

Regarding your questions:

1. We are going to support tax returns from 2013 (january to August when he was working at the US), and earlier years (2012 and 2011). If you are in México this year (2014), you can always give tax returns from 2013, 2012 and 2011 as well. In add, any asset is welcomed (savings, shares or whatever).

2. Filing I-130 through DCF usually is quicker. But it depends always on the consular post.

3. They dont care wheteher you had job or not for being sponsor. If you can show your income as the main sponsor that is enough. If not, a co-sponor can be an altenartive.

My advice is to file I-130 form as soon as you can if both have clear to live in the US.
