Good question for a lawyer.

Are you thinking about suing the government for excessive time taken by FBI doing name check?

My lawyer said it could cost 2-3K but I frankly think it is a bit high (he's based in NY). There are soem places that can help for a much lower fee. So sorry to hear about your situation. How long have you been waiting for the name check?

We have also bee waiting for a very long time for the EAD (over 1 year now!). We have our AOS interview and then we will know whether we still are in name-check and other processes.

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

My lawyer said $3K but I thought it was kind of high. I am gonna shop around a bit before going forward with it. Anyone else has any other experiences?

We've been waiting for the name check for almost 2.5 years :(

Check out immigrationportal, there are many threads about a WoM. From what I've read it's much cheaper to file yourself. Try Google as well.

OP, this site is about someones experience with filing a lawsuit but they were on a DV (lottery), it might give you an idea of the process. I came across it when I was stuck in name check clearances.

Interview - February 13th APPROVED! day 152

April 6 - wedding date day 204

Aug 22 - AOS interview date day 101-total days 342

Sept 29 - green card arrives, done until June 2008 day 140-total days 381

2008

June 30 - I-751 mailed total days 1025

2009

March 9 - Removal of Conditions approved! total days 1277

Check out immigrationportal, there are many threads about a WoM. From what I've read it's much cheaper to file yourself. Try Google as well.

I work for an attorney. I know how to type pleadings and follow form examples. No way in hell would or will I file my own WOM when the time comes.

might be worth your while only if your also willing to go to court by yourself as well. Better be well prepared beyond beyond beyond.

I have read much on WOM and feel confident with the process, but would not do it myself.
