Hello

Reading throu the DCF files, I am not sure if I understand correctly so could any clarify plz for me... when a person enters the US with a DCF visa can they enter in any international (let us say Detroit Metro)...not the major airports like NYC, Chicago, Atlanta that I know do the work premits (sorry donnot know the name of this file)...SS number.

Also what needs to file once my husband is here, for him to be able travel out of USA then reenter...and is there a time frame he needs to wait to do this?

DCF is not a visa, it is the process where a US Citizen who is living over seas files the I-130 petition at the consulate or embassy rather than at USCIS here in the states. The result is the same the foreign spouse is issued a CR-1 or IR-1 visa for entry into the USA, and are a Legal Permanent Resident on arrival into the USA (Green-Card) and can work immediately if they wish no work permit required the I-551 stamp and green card makes the person work authorized. Their passport gets stamped with an I-551 stamped at the POE indicating Green-Card and can apply for SSN a few weeks after arrival in the country.

Also all international flights from over seas arrive in the major international airports, smaller "international" airports like Detroit metro tend to originate from places like Canada, and you will be pre-cleared by the Customs and border service in Canada.

The primary requirement is that the US citizen is considered a resident of the foreign country for a period of time that can very by country, and some consulates do not offer DCF at all.

First of all, Dan I would like to thank you for your reply. Second, not to sound ignorant, I am just trying to understand...what does the above statement mean? "pre-cleared by customs and border service" Could you plz clarify this... I thank you ahead.

Pre-clearance means that the person is checked by customs and immigration BEFORE getting on the flight that arrives in the US - ie. Detroit. My husband and I visited Ottawa, Canada over the holidays and travelled via connecting flights in Detroit. We were interviewed by Customs and Immigration officers in the Ottawa airport - in other words - 'pre-cleared' for our flight to Detroit. If there had been a problem with our documentation it would have been identified at preclearance in Ottawa and we would have had to address it before we would be allowed to enter the US.

Residency requirements are different from location to location. Best to check the consulate website or e-mail the consulate directly to determine local procedure. Not all consulates accept direct I-130 petitions.

Hmmmm, DTW is in the top 10 busiest airports airports in the world so I doubt it would be considered "small".
