Timeline

My fiancé and I have been approved for the fiancé visa and he cannot immigrate until sometime next year. He cannot immigrate until after the completion of his PH.D. Which would be next year. We are going to plan for a wedding here (US) in September since now we know that it is not illegal for us to marry on a tourist visa just as long as he is not trying to immigrate. We have submitted a withdrawal letter and there is no telling when our case will reflect the notice of withdrawal. We are concerned about him getting denied for a tourist visa because we currently have a pending immigration visa. He has an interview at the London embassy on Friday and he is taking his Ph.D scholarship letter, he will be showing that his schooling has been paid for for the next school term, a letter from his landlord (showing he has paid his rent up for the next year), his school report (showing how long he has left in his program and the successful progression), he is also going to show that we did apply for a fiancé visa and we have been approved. We are very much aware that we have to file for a spousal visa before he can immigrate here.

Have you or do you know anyone that has had a pending immigration visa and applied for a B2 visa at the same time?

Do you think his evidence would be sufficient enough?

SN: My fiancé is a Nigerian citizen he is just in the UK to complete his PH.D.

OAN: This is so overwhelming. :(

You haven't been approved for a fiance visa. Only a petition has been approved. Visa approval requires application, a medical exam and interview. That would take you about 3 more months. I don't know what it takes to get London to issue a tourist visa. Just wanted you to know not to say "Look, we were approved for a fiance visa."

If he gets a tourist visa, make sure he actually gets in the US with it before you put out a lot of money on a wedding.

Depending on your desired timeline, the visa issuance could be easily dragged out until summer. Then valid until maybe November. Then an extension requested to put it to maybe May 2015.
