My husband and i had been fighting a lot and he wants a divorce.Everything is so complicated because we have a 6 month old son.I was pregnant when i came here and we constantly fight because he has no interest in me and it made me think that the reason why he brought me here was because he got me pregnant.He always wants to break up with me before when we're just enggaged.I love him so much and i dont ever want a divorce all i want is him but he just doesnt care for me.Everytime we fight he tells me that he is not gonna do my adjustment of status and now im staying here for a year and i havent filed for my adjustment of status.I dont think its right to bring someone in a different country legally and then just drop all the process needed and just divorce.What should i do? what rights do i have?Will they take away my kid from me and deport me?

Look for a good marriage counselor in your area.

Dec 12th, 2013 – Mailed in I-129F Package to Texas Lockbox.

Dec 13th, 2013 – Package Delivered.

Dec 18th, 2013 - NOA1 Text and Email

Dec 20th, 2013 - NOA1 Hardcopy received in mail. Notice date on hardcopy says December 17th.

Jan 24th, 2014 - NOA2 - update on USCIS website

Feb 12th, 2014 - NVC has received our approved I-129F and we were given a Case #

March 15th, 2014 - Passed St. Luke's Medical Exam

March 15. 2014 - Rescheduled Embassy Appointment to March 24, 2014

You're broken heart will make it difficult for you to make a rational decision. You should contact a good immigration attorney who also practices family law. Most consultations are free and you can decide later what to do. It's a good idea to talk to a few on the telephone before you make an appointment.

Is'nt there someone in the family that can mediate

encouraging U both into counseling?, with small kids

involved and what could be additional financial stress

he was not use to he could be feeling overwhelm, the

honeymoon don't last 4ever, reality sets in.

Try to talk with him when a good time presents itself

*not talk at him* that causes more fussing. In a marriage

both sides at times have to compromise a bit..

maybe honeymoon doesnt last forever but is it normal for a husband not to tell you that he loves you,dont wanna kiss and hug and just wanna spend his time by himself?He just dont have anything to do with me i feel like im a slave i dont feel like a wife.He never tell me anything nice.He is very affectionate to animals and our baby but never to me.I love him so much and i dont wanna go through all this but but with how he is to me i think its time just give up on this

If u still love him... Try to have an open honest talk with him... A marriage counselor might be good.. But give him enough space to not be smothered... Let him know that you want to contribute to the household and would be able to be more independent if you had legal status... Don't let things drift too far that they become un repairable... Good luck.

To answer your questions - you have essentially no rights. You can't adjust status without your original petitioner, you theoretically can be deported and if that happens changes you'll be able to take your kid with you are very small.

is the child a US citizen? where was the child born? If it is his and yours you may have options to stay in the country because the courts do not like to separate children completely from there parents.

I wish you luck. I would still try and work things out with you. If you do truly love him you may need to set aside your feelings for a little while to find out what is wrong with him. It takes 2 to love and 2 to fight. I know it sucks that you may have to do all the work at first but if it is important to you then you will be the one doing most of the work at forst.

This is wishful thinking and bad advice.

A USC child does nothing for her.

There are plenty of foreign parents who have been deported despite their USC children.

There are two separate issues; immigration ad child custody.

There is nothing that can be done to make her legal. The only exception would be to file under the VAWA but OP has not stated any abuse.

Child custody will depend on the best interest of the USC child. This has nothing to do with immigration since the child is a USC and mom's immigration status cannot be changed by a family court.

Go see a lawyer. This is not a DIY case.

Unfortunately you don't have many rights. What you can do is get a divorce and move on with your life. Worst case scenario, get your kid and go home, where you can count with the support of your family and friends.

I really feel bad for her, but her options are not good at all.

I implore all immigrants with children of USCs to marry and get a spousal visa, not to have children out of wedlock and come on a fiance visa.

Child is a USC and the child of her husband. The odds of a state court allowing her to remove him to another country, in particular a country which is not a signatory of the Hague Convention on Child Abduction, is pretty small.

I really feel bad for her, but her options are not good at all.

I would presume the child to be a dual citizen, which might give the mother some options, none of them ideal, to be sure.
