Is there a better rate of approval for CR-1 Visa compared to K-1. I was married before to someone from the Philippines. The marriage ended after only 3 years. I assume this will result in red flags when applying a second time for a visa.

Are the odds of being approved any better with a CR-1 visa? Can you still apply for a k-3 visa?

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London
7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production
27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

If the ex has not become a U.S. Citizen at this point, your still liable for the I-864.

This could be an issue if your annual income hovers around the poverty line given you, the new fiance, the ex wife, and any children (still in in your home) you have all must be included in the calculation.

As far as any other red flags, I see not reason why you should have any at all.

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

It's any children of the petitioner period, no matter where they live, 18 and younger. They must be counted even if they do not live with the petitioner and even if the petitioner gives no money for the children's welfare.
