Hi everyone!

I got an email/text alert from USCIS that they sent my AOS interview notice letter on Jan 21st but I haven't gotten anything yet. So I called USCIS and requested a special request thing but I'm just really worried.. (My interview date is late Feb according to the website) I'm worried a lot because my EAD was either lost or stolen in mail, so that experience pretty much makes me be freaked out about getting every mail from USCIS.

What if I don't get the notice on time? Should I try infopass? Can I just go in the office on the interview day without the notice?
I don't know what to do...

If you did not receive your EAD in your mailbox, and now you haven't gotten your interview notice, it sounds like you need to figure out what's going wrong with your mail -- because the next thing that won't arrive will most likely be your green card. Is your name inside the mailbox, and does your postal carrier know that you live there and have a record of that? I made sure that my husband's name was added to the little card INSIDE our mailbox, the one that only the postal carrier has access to.

As for the interview, I think you need the notice to attend, since it has bar codes and information (including any special instructions), so you're going to have to get USCIS to resend it somehow. But sort out your mail delivery issues first, otherwise anything they resend is likely to go missing too.

We changed the address and the EAD was sent to our old address and we think the current residents there just took it....We got change of address confirmation letters in mail without a problem. So I don't think there's no problem with our mail delivery system - it has both names on it.

Do you think I should get an appointment with infopass?

USCIS will not allow the USPS to forward any mail. It is returned to sender--i.e. the USCIS. I would call the USCIS "help" line and ask for a tier 2 human and inquire about any returned mail pieces. Then make certain they have your current address correct You might also want to send a letter/card addressed to the foreign spouse with your work address as the return address and see if it arrives. There are two steps to getting mail, unfortunately. The regular carrier and the substitute carrier. Our acceptance letter for the I-485 was not delivered by the substitute carrier, but the bio appointment letter was delivered by the regular carrier. I would still go to your local postoffice and complete a delivery card and just tell them to deliver all mail address to that address. This is more of a problem if the wife has her maiden name as my wife does and you live in an apartment complex.

It sounds like the change of address has not made it into the system. Did you also complete a change of address for having a current petition?

Yes the change of address has made it to the system, like I said, we've got the confirmation letters in mail.

I also asked USCIS agents if they have our current address in the system and they said yes... I'm really confused and frustrated why this is happening :(

You need to determine if this is a USCIS address problem--i.e. the people who are looking at your file have the correct address, but those that are mailing stuff to you are using your old address. USCIS is too big and their computer systems do not talk to each other. Or is this a USPS problem of the carriers taking it upon themselves to decided that you do not live at that address and thus returns the mailing--which does have your new address--to the USCIS.

The confirmation letter only tells you that they received it and that location in KY has processed it. If your current petition is in VT or CA, they may not have the new address yet because their computers do not talk to the computers in KY. That is why you need to CALL and ask about returned mail pieces. Either that or make an infopass appointment. Are you asking the first person you are talking to all these questions? That person is in a call center and can basically see what you can see on-line. You need to get up to a tier 2 ISO officer who can actually look at the case. Both of you should be there just encase they want permission from the other spouse, but it is usually the petitioner that must call.
