So just checking in....just waiting for March 24th to come along!! Time seems to be moving so slow for this final step to arrive. Anyway I am very happy that others were able to schedule earlier interviews even though we were declined that request. It never hurts to ask that's for sure. I was the one to email the request to the embassy. At least they know that I am eager for my husband to join me!! I know every embassy is different.

Hello Everyone,

I have applied for my wife IR-1/CR1 spouse visa. It was approved from USCIS in Nov 15th 2013 then i received NVC number in Jan 15th 2014. I have completed DS 260, DS 261 and send the civil docs (like 2 photo, Marriage and birth certificate and passport copy) and I-864 with the pay check, 3 yrs tax return and W2 and 6 months of paycheck. As per the NVC, they received all my docs on 02/07/14. Does anyone know how long does it take to complete the applications, send it to US embassy in India and when will we hear abt the interview date ( can we re-schedule the interview date to bit earlier date ex- if the interview date is on 03/06/14 then can we re-schedule to 02/28/14 or not).

Thank you for your help and best of luck everyone.

Dhruv

Case Complete can be anytime once they review AOS and IV. Have you called NVC?

Your petition doesn't get sent to embassy until you are scheduled for interview. If you have case Complete now you would be in the queue for the next month of interviews April. So first you need case complete.

Now once you are scheduled for interview and your case gets shipped to embassy and they receive you can contact your embassy and request an earlier date. The way these embassies are so booked highly unlikely to get an earlier date but it doesn't hurt to try.

Also rescheduling is whatever is open not like you can pick your date. I have seen it done but its a hit and miss and based on cancellations and such.

Keep calling NVC until you get case complete

Thank you for the reply dwheels76....I call NVC like twice a week to see if any updates has been taken place.....is there anyways to expedite the file or not...

Getting an expedite at NVC is alot harder than at USCIS you have to show cause. And unless life or death, deployment or other medical reasons or hardships its very hard. But you can always request you never know.

I remember I called NVC 2 to 4 times a day from my NOA2 date (May until I heard they shipped off my packet to embassy March) yep 10 months). hehe

? thank you , without your help I will be lost , thank you for every thing. Pleas dwheels76 again I need your help, do you thing the statement and the list of doc wich I saw here for re-stabilition domicilie in USA will work in our case? Can CO denied the list od documentes with the statement of my housband ? Here in vissajurnary I saw I sample how to do it. Any advise will be help for us , like always. Thank you for every thing.

Well its about showing that you have domicile in US or establishing one. Here's the list I think you speak of. Get what you can get together who should have some already if he was just there a short while.

What if I (the petitioner) live with my spouse in their foreign country? Do I need to include anything in either package?

You'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. Please read the I-864 instructions (pages 3 and 4) for information about it. This is NOT needed if the petitioner is living in the US. Here is a sample cover letter to include in the package (it lists MANY possible documents, some may not be applicable of course, to prove that you have, or will re-establish, domicile in the US):

NAME

SOCIAL SECURITY NUMBER

FORM I-1864

No. 15 Country of Domicile

I, XXXX, am currently residing in FOREIGN COUNTRY with my spouse, SPOUSE'S NAME. Below you will find a list of attached documents to show that my principle residence is in the US and the steps that I have taken to return to the US with my family.

• XXXX drivers license showing permanent US address

• Retirement fund statement showing permanent US address

• Mutual fund statement showing permanent US address

• XXXX license currently up to date

• Renewal of XXXX membership

• County tax bill showing I still own a vehicle

Steps I have taken to return to the US to take up residence:

• Contacted schools for requirements of things to bring to register my children in school

• Contacted my auto insurance company to find out about re-instating my insurance on my car

Supporting documents for the above steps I have taken:

• Lease agreement for our house

• Email from schools regarding registration requirements

• Email from my former auto insurance company regarding my inquiry

• Email from XXXX with estimate and correspondence regarding shipping our belongings

I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of spouse's admission into the US.

I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.
