Timeline

Hey guys,

my wife was given a 221g because she didn't have her name change documents (school leaving certificate and gazette copy). She was told to drop off those documents along with her passport at one of the vfs locations in india.

do you know how long would it take now for them to issue the passport back with the visa once my wife submits the docs next week..

I am interested in this topic as I too want to know if the same will happen to my wife.

Long story short: I filled out the I130 for my wife with MY surname. I had her add my name as spouse in her passport with surname being my last name.

Now all her school certificates have her first name and now middle name in them where passport includes surname = my last name with given name her first name and middle name.

I dont think any official name change document took place.

We are at NVC and I'm wondering if this is going to be issue come interview time?? OP did you do something similar???

From what I heard it takes few weeks. I would suggest to keep inquiring once your wife submit her documents.

Here is what I would suggest. Submit your wife's original birth certificate and if possible school leaving certificate. Get your wifes father and mother's affidavit about the name. affidavit will be an extra document. I also had my wife's adharcard with new name after marriage. She will have no problem. Good luck.

Name change issue is common in India . Best and simplest thing is just get an affidavit of name. A stamped paper which will say something like "Sami smith and Sami jones are the same person, however had a name change b/ c of marriage"

Surname change because of marriage is considered to be positive in cr1 application.One of my friends got her last name changed after marriage.She did not get any document for it ,just provided copy of old passport and copy of new passport with husband's name and her new name on it.You might have to provide wife's parents affidavit stating her old name and any document like id card stating her old name(unless they are asking specifically what they want).

She was issued 221g listing many documents on it.

She submitted all documents within 1 week.They took over 15 days to make decision.In those 15 days they called few people to enquire about marriage and took phone interview of beneficiary(interview of 30 min).So i think they should not take more than 10 to 15 days after submitting all documents(unless background check is taking long or they need more time to check beneficiary's criminal history).

ROC sent (DAY 00) -2/21/2014

ROC received at center (DAY 03) -2/24/2014

NOA received at home (DAY 07) -2/28/2014 (NOA dated 2/24/2014)

BIO received at home (DAY 12) -3/05/2014 (bio appt on 3/20/2014)

BIO appt (early bio) (DAY 12) -3/05/2014

Approval decision date (DAY 89) -5/21/2014

Approval letter received (DAY 91) -5/23/2014

Card received at home (DAY 102)-6/03/2014
