I just back from UPS store. The pkg is on it's way to NVC.

I was looking for some help on the income portion of the 864EZ. I have seen many people have issues with mismatches that cause checklists or RFEs.

Per the instruction it mentions that state the income you are using to meet the requirement for this form for part 18-'My Individual Income Currently', for this I want to put the exact amount from my w-2 from the last year which is sufficient to meet my requirement. Plus since I am filling out I864-EZ I can only use my w-2 income. However, during that tax year I have additional income from capital gains and other items. So now, when I fill out the next part 'Federal Income Tax Information, Total Income' section I would think I should put the total income w-2 + other incomes. This will lead to a mismatch Individual income and Federal tax information for the last year.

I am afraid that this mismatch might cause issues that I have seen others report. Is this an issue? Has anybody ran into a similar issue?

The question on current annual income isn't based on W2s or previous years. It's how much you're making right NOW, as of the filing of the form. The amount is taken from your employment letter and/or pay stubs.

The question on the three previous years is based on tax information (preferably tax transcripts as that's a more correct number than tax returns).

Keep in mind, some vaccines are age-specific. If you're over 18, then there are very few required vaccines.

Hi everybody, good to see some folks here from the April thread... can't wait to have them all join here!

I have two questions if you guys can help me get clear on these two:

1. I-864EZ - the infamous question 19 - do I have to enter the numbers for agi for all past three years if I select that I only submit the last year of taxes? And is that truly a choice as they say (optional) i would hate to get a checklist for that....

2. Taxes - I did mine as Head of Household - for which I am considered unmarried as per the IRS guidelines and i have a child who's my dependent. But from what I read here i got a little freaked out about this seeing the argument about the married vs single. The option head of household doesn't say anywhere that I claim to be single so I just wanted to see if anyone has any thoughts on this?

Considered Unmarried

To qualify for head of household status, you must be either unmarried or considered unmarried on the last day of the year. You are considered unmarried on the last day of the tax year if you meet all the following tests.

  1. You file a separate return (defined earlier under Joint Return After Separate Returns ).

  2. You paid more than half the cost of keeping up your home for the tax year.

  3. Your spouse did not live in your home during the last 6 months of the tax year. Your spouse is considered to live in your home even if he or she is temporarily absent due to special circumstances. See Temporary absences , under Qualifying Person, later.

  4. Your home was the main home of your child, stepchild, or foster child for more than half the year. (See Home of qualifying person , under Qualifying Person, later, for rules applying to a child's birth, death, or temporary absence during the year.)

  5. You must be able to claim an exemption for the child. However, you meet this test if you cannot claim the exemption only because the noncustodial parent can claim the child using the rules described in Children of divorced or separated parents (or parents who live apart) under Qualifying Child in chapter 3, or in Support Test for Children of Divorced or Separated Parents (or Parents Who Live Apart) under Qualifying Relative in chapter 3. The general rules for claiming an exemption for a dependent are explained underExemptions for Dependents in chapter 3.

And finally for purposes of the spreadsheet do I need to fill it in or is Saylin doing that? My AOS bill came 2/11 together with the DS-261 email. I did both the same day. The AOS fee shows paid as of today 2/15. I'm working on sending the AOS package next week.

BTW: NVC got my i-130 and i-129 on Jan 7, i-130 case assigned 2/11. Just for farts and giggles NVC sent my i-129 to my embassy back on jan 10, and told me on the phone that I need to call the embassy and ask them if they will process my K3. I called the embassy and they said no because the i-130 was approved at the same time. So I had my hopes up for a moment. Why it took a month to log in the i-130.... well we all know..... rolleyes.gif

Any feedback on that question 19 and taxes is much appreciated!

For question 19, you have to fill out all three years, whether you're submitting all three years' information or not. And also keep in mind, this is very important: you use total income if you filed 1040 or agi if you filed 1040EZ. Make sure you check each year you filed as you may have used a 1040 one year, but a 1040EZ another year (so, you may use a mix of total income and agi).

HOH is a perfectly fine status to file. Most people do MFS or MFJ, but if you qualify for HOH, then that's fine. No worries!

No problem! I see many times people getting checklists cause they didn't carefully read the instructions right in that question.

And you can figure out what form was filed right on the tax transcript. No need to talk to the ex ;)

Quick question, I saw in the OP, that if the interview is scheduled after April 14th, then the beneficiary needs to take updated tax forms with them? Is that true even if one has a joint-sponsor? Will they ask for the updated tax papers when they send us the interview package (I think its called packet 4)?

A little concerned. I left US in 13 while my divorce was still going thru. I don't know if the divorce was granted( I assume it may had) in my absence. I don't have the final divorce decree . However I have the summon papers that I was served by my ex wife regarding the divorce. If I am not wrong I think I need to send the summons to the NVC. I am both the petitioner and the beneficiary.

I am trying to arrange all the documents for the NVC stage. As I am expecting a case no next week.Any advice will be very helpful.

Yes, if your interview is after the tax deadline on April 14th, then 2013 tax information will be required from the petitioner and all joint sponsors (if it wasn't already included at NVC).

Does this mean that after april,the petitoner and co sponsors need to fill up the form I-864 or the beneficiary may just bring the latest tax return transcripts in the interview?

Well, when I went to my interview, which was after the tax deadline, I just brought the new year's tax information. Although looking back, I'm not sure why I hadn't brought an updated I-864 as the numbers were obviously different. It might be fine without an updated I-864, but I'd suggest bringing one anyways, just in case.

Hi Saylin,

I hope you can help enlighten me. Do my Co-sponsors need to submit there W-2's,1099's,scheduels with their I864 and I864a? We ordered and received mine and their joint tax transcripts from the irs last week. Is it still necessary to submit all these documents. I thought that was the purpose of the transcripts. since my brother and his wife make well over the guidelines, I thought all they needed was an employer letter and a months worth of current pay stubs. My Brother has been self employed for the past 10 years but as of the 1st of Jan, he has got a real job! and my sister-in law has been with the same company for 15 years. Do we need to separate their incomes also? I paid the AOS fee, it showed paid and printed the barcode sheet tonight, hope to mail off,all are I-864's in the packet next week. Just pray we can avoid any RFE'S.
