I received this announcement via USCIS email yesterday. What infuriates me is that it landed in my email inbox at 4 PM on February 14!!! If my place of business did this to people, they'd be out of business.

Thanks for the info but i think ceac is still down. I checked my status through ceac just now and it's still giving me the same error. Guess they havent totally restored their systems yet..

Thanks for the info!

I've been waiting whole day today for this.

I would say, I had time today to prepare to fill the form.

Hopefully by tomorrow you will be able fill out and submit the form. :) It's not that theyre working on your case or something, i think theyre just doing maintenance in general coz even a status check on a completed case gives an error msg. Maybe theyre giving the site a new look hehe :P

The thing is if you have a mortgage.

Get the value of your property assessed by a professional or three (like a realtor.) Basically what you could realistically sell your house for in the current market. Then minus what is left of your mortgage. This is how much assets you have in your house. Keep in mind that the NVC or consulate may not accept using your ONLY home as an asset. Generally they only want to see assets that will not leave you homeless and jobless.

I am $1300 away from the poverty line :( However, my house is paid up, no mortgage. I also have around 40K in my saving and checking account. Do they count bank account as assets.

Hi Saylin,

I found one more error on the ds260. I clearly told my document guy that i will be moving back to Illinois when my wife is here, so in about 3 months but he use my Illinois address as a permanent and current address on the ds260 but i am still living in california. do you think i will need to call NVC? i am going to starting applying for jobs in illinois and then move back once i land a job.

Your current address is the correct one so yes you should correct this! Your spouse can update the address at the POE to the one you will be living in at that time.

With 40k in the bank do not bother including your house. They would rather see cash assets than ones needed to liquidate. Just include bank statements showing the cash in there.

Hi Saylin,

Finally I managed to get the originals to my hand. I'm going to courier (UPS) them to NVC tomorrow morning. I have not informed my attorney and not planning to do so. Will that be a problem later? I'm little concern because I'm sending the original docs and my attorney has already sent one IV packet.

Another thing is I wanna make sure that I send all the required docs. I'm sending the docs in following order. Let me know if this is good.

- Barcode sheet

- Cover Letter

- Original BC (Sticky notes)

- Photo copy of BC

- Original Marriage Cert(Sticky notes)

- Photo copy of Marriage Cert

SEEMS TO ME LIKE ONCE U REQUEST EXPEDITE, NVC SEND U A CHECK LIST EVEN WHEN THERE IS NO NEED FOR IT, IT'S LIKE THEY WANT TO SPITE US BECAUSE WE SEND IN A REQUEST FOR EXPEDITE. SO FAR I HAVE NOTICED THAT A LOT OF PEOPLE WHO DOES THIS GET IT. NVC IS LIKE: " THIS PERSON REQUESTING EXPEDITE, THEY WANNA HURRY US UP, OK WE GONNA SLOW THEM DOWN WITH SOME FORM OF SOMETHING."

It seems that way. However, my attorney called and the matter was settled over the phone. In fact, my case is complete and now awaiting interview date. In the meantime we got another email from NVC asking for two FOREIGN PHONE NUMBERS to expedite the case. In any case, I should have an interview date for April at the latest. Fingers crossed!!

Where is your wife living right now? She needs a police certificate for the countries where she lived for more than one year (double check at the DOS or consulate website), for the past five years ( double check at the DOS or consulate website). I think what the last bullet is saying is the, in case she's a non-Indian, who lived in India but currently doesn't, they do not issue a Police certificate for her. That's how I'm interpreting this. But still, she needs police certificates from where she lived (except the US)

Your interpretation is correct. She is non-Indian and lives outside of India. The bullet points I gave was directly from NVC checklist email. My attorney called and the issue was resolved over the phone. In fact, my case is now awaiting interview date.

I have heard disaster attorney stories on this forum and others, but when you hire a competent and experienced one in this field, you are not disappointed. Hooray to my attorney who got everything right. In fact, he had explicitly emailed me about the Indian Police Certificate issue before we sent package to NVC and how I did not need it for my wife. All's good!!

Hi NLR,

I mentioned earlier in the post that my attorney doesn't have much idea about the process and he sent photocopies of the documents. I thought he knew about the process and that's why I picked him. I realized I made a mistake after going through this forum but it was little late at that time. Now I'm trying to send the original BC and MC to NVC and when I called NVC they also asked to the originals.

I'm really disappointed with my attorney. He gave me really hard time.

As I'm getting ready to send the docs, can you or Saylin confirm the below is right?

NVC probably won't care (or even notice) your filing status. But the status you chose is wrong. It should have either been MFS or MFJ (or even HOH if you qualified). I would suggest amending them ASAP. If the CO at the embassy/consulate sees it, then can take that as a red flag ("why are they applying for a SPOUSAL visa when the petitioner is filing as SINGLE?"). And being a citizen or not doesn't mean anything. Please read the bottom of post 2.

NVC doesn't send the forms to you. They'll merely direct you to their website with links. So, yes, once the AOS shows as PAID on the payment portal, you can send the AOS package. No need to wait on them for stuff you can do now.

I have been filing past 3 years as HOH (head of household) since I have parents as dependents. It shows on all my tax transcripts as HOH. It just does not show marital status. I notice the W2 I got from my company from last year shows single. I think I can get that fixed, and I am not filing for this year until after sending this AOS package. By the time my spouse do go for interview, I have either have correct W2 or filed for my taxes.

Does the above work?

My point, NLR, is that the window for maintenance began at 9 a.m., and they didn't send out the warning until 4 p.m. Normally, one gets a warning BEFORE the maintenance window starts - not half-way through.
