Hi,

I am not yet at the NVC stage, but hope to be very soon :-)

In preparing for the NVC stage I started to fill out my AOS documents. I ran into the I864-EZ and per the instructions I qualify. I seldom see it discussed here, is it still allowed for IR1-CR1 spouse visas? Any gotchas of it causing more RFEs or checklists vs the I864? I have gone through the first few pages but didn't see the 864ez discussed.

Yes, the I-864EZ is still used. We used it :) It's nicer than the I-864 as it's shorter, thus more simpler and faster to fill out. And less chance of making a mistake! If you qualify, definitely use the form!

My case is now complete at NVC. How long does NVC take to send file to embassy and schedule an interview date?

NVC doesn't send the case out until AFTER the interview date has been scheduled. And the time frame for an interview date varies by country.

I am planning to take 2 weeks vacation with my family however my boss is giving me a hard time in approving my leaves. I feel like quitting the job now. I remember in one of the forms when we submitted our petition we had to give information about the current employment details which i did.

So would it be a problem if i quit the job in the process? Also does form DS260 has questions on my current job? Sorry not able to view the DS-260 screenshots which you have posted.

As another member said, it doesn't matter if the beneficiary is employed or not. I was unemployed during the entire immigration process. Didn't matter whatsoever. Yes, the DS-260 asks about current employment. You can just put 'unemployed' as I did.

I have decided that I am going to reschedule my medical as it is not advisable to have it until London have received your case. Otherwise they cannot be matched with my case.

I know you said it will be fine to change my date even though I said it was going to be the 20th Feb on my DS260 when explaining "no" to the vaccination question, but do you think it would cause a problem at the interview? What if the officer interviewing me sees that I suggested that my medical was on the 21st Feb on the DS260 but notices I actually had it at a later date? Could he think I was being deceitful (even though I'm not)

I know I am probably worrying over nothing and he/she couldn’t care less what date it was as long as its done, but I cant help but worry! :-(

Alright, do the following: take a deep breath in, let it out. Take another deep breath in, let it out. You will be fine. There is nothing to worry about. Like I said before, people have to cancel/reschedule medicals all the time. You won't be viewed as deceitful. Again, nothing to worry about!

will nvc send affidavit support forms or i need to download them from online?

No, NVC doesn't send you the forms. They'll send you a link to the forms, but you can do that yourself. Just go to USCIS's website and find the I-864 forms. Please go back and read posts 1 and 2 as you've obviously missed valuable information.

hello to all. is the AOD and IV bill process still separate? Will the issue the IV bill independently of the AOS bill, or will they wait until all of the AOS material is approved?

Yes, the AOS and IV are two separate tracks that have nothing to do with one another. The IV bill is dependent on the DS-261, not the AOS track. Please click on the flowchart either in my signature or on post 1 to see for yourself.

How long does NVC take to schedule an interview after case is complete?

As I said above, it varies by country. Some people find out within a few days, others a few weeks. I have I-864A Questions...

The NVC sent us a letter stating that we provided incomplete information or have not responded to some questions.

On the following checklist for I-864A they listed *Part 1 Information on the household member* as being incomplete. They then said *Please answer all questions completely*.

I was totally confused as to what mistake we made on part 1. So I called the NVC last night and the operator said she couldnt tell me exactly question we didnt answer completely..I pressed her hard and she revealed that the fact that usually the NVC will not accept a blank reponse to #3 of part 1 (Place of residence)...Which makes no sense since in clearly says on the form in parentheses *(if different from the mailing adress)*..Well our mailing adress is the same so why wouldnt we leave #3 blank?

So I could easily fill out the I-864A form with part1 #3 filled in and sent back to them, but was that really the reason we were sent the letter asking for more information? It's really hard for me to know..What if it wasnt and we get sent another letter delaying the process further?

I just am lost on this one..

I read the I-864A instructions over again..There is one possibility that I could find where we might have been missing information on part 1..The instructions state that we need to show proof of common residence..I just assumed our tax transcripts would be enough..Certainly that is proof..but maybe we were supposed to supply some other form of proof? Yes or no on that?

I am really surprised that at this stage of your petition almost going to complete, you are asking such basic question,

What did your write in your I130, passport clearly will specify which is surname and family name, if you don't have family name leave it blank, the answers to your question is in your passport,

Please don't mess it up . At this stage of processing.

i got this answer already but i didnt have his passport and didnt have any paper on my hand at that time so i cant make sure what to put so i just ask this to be make sure and later i got his passsport and did this already

hey that is the same thing that happen to us , we got a letter that said tax return for 2012 is missing/ incomplete. when we called them we got to understand that the tax return we used is not the 1 they want they wanted the federal one. But they send complicating letters, They make the letter of RFE / check list so complicating after reading it we dont even know what exactly is the problem; And to make it worst when we contact them to find out the proper details, NVC operators refuse to help simplify it. mad.gif . Now we have to wait 30 business days to get a review again.

No, NVC doesn't send you the forms. They'll send you a link to the forms, but you can do that yourself. Just go to USCIS's website and find the I-864 forms. Please go back and read posts 1 and 2 as you've obviously missed valuable information.

i told my father to go lawyer office and tell him to find I864 form and they have to send this form to me in bangladesh than i will sign and send them back so it will take little time

Any update on this? I'm curious as to why you received an email saying the I-130 was undeliverable, as the impression I'm under from your signature is that you already had a notice that the I-130 arrived at NVC.

I just finally got home from vacation and check my mail box finally receiving my hard copy NOA2 and a letter stating to complete a AR-11, which is an error since I'm the US citizen who changed my address. Not my husband who changed address.

Since I changed my address so close when they approved our case they sent the approval letter to my old address, but then it was sent back to USCIS. USCIS then sent that same NOA2 with attach letter to complete a AR-11 thinking my husband was already with me in the US

I called USCIS, which basically knew they would say it was an error after telling them that my husband is in his home country and I'm trying to bring him here. Going to get a person to call me back to make sure everything is in order and that to see if they sent my petition to NVC .

I tired to call NVC, but as you know there not there since of bad weather. Will try tommorrow. happy.png

We finally got our DS-260 finished and filled out.

In case this comes up in future for anyone else, the way we solved our J-1 Visa question was this:

- when we clicked "Yes" (as in, "Yes, he has not fulfilled the 2-year residency requirement"), the explanation box popped up

- we put the J-1 Visa numbers in there as well as direct quotes from those documents that stated "two year rule does not apply"

Hopefully that will be sufficient! We figured it was safer to click the option that gave us room for an explanation, than clicking "No" and having them dispute that.

Saylin, you can add our AOS and IV dates to the spreadsheet from my signature if you want - in your copious spare time of course. ;)

In case this comes up in future for anyone else, the way we solved our J-1 Visa question was this:

Although it would seem that you wouldn't have needed to fill out question 3 (since it says if it's different), that's likely the reason for the checklist as it was left blank. Some reviewing officers take a blank as you missing the question. There were quite a number of checklists I think it was in December where people left that question blank (for good reason), but then got a checklist for it. If that's the only thing wrong for the AOS package, just correct the I-864A (just write in the same address on #3), and send it in.

GM VJ Fam just an update. It took me a few days to feel up to writing this and I'm still sad. My husband went for his interview in Kingston on Feb 7th. His appointment was at 9:30 am and he didn't leave til around 2 pm. Here's the kicker..... He was rescheduled for March 14th because they said he didn't have his DS-230 form. Notice the form they requested wasn't the DS-260. The craziest part is...We already submitted all paperwork, evidence, and paid the bills online. Plus, I emailed the Kingston Embassy the DS-230 back in January for them to give my husband a interview date. My husband also had copies of all the paperwork and evidence submitted including the DS-260 that was submitted online. SMH.. I emailed the Embassy and their response was that they are not used to expedited cases where the paperwork is submitted online maybe the officer didn't check. What!? What type of response is that? My husband was rescheduled for a whole month later because of

someone else's mistake. How fair is that..... SMH.

I'm so sorry that happened to you guys. Did you try emailing the embassy and requesting an earlier date being it wasn't your fault?

Although it would seem that you wouldn't have needed to fill out question 3 (since it says if it's different), that's likely the reason for the checklist as it was left blank.
