charged me for the phone call through skype. I think gmail phone is free, but the reception is always so bad it's not worth it to try.

This AOS income part is confusing me and the fact that people are getting RFE's for putting the wrong amount is scaring me. I ordered my tax transcripts for the last 3 years and I always file married filing jointly (1040) so my husbands income and mine are combined as one figure. I am not needing to use my husband's income for the AOS as I make enough but do I still put down total income even though "my total income" also includes his?

Yes, it'll be a combined income, but that's what they want. Make sure you include your W2s to show individual income.

Hi all!

We have encountered two questions on part 6 of the I-864, dealing with line/questions 13-14:

1) 1. If we are going to submit the last 3 years of tax returns (IRS form 1040), do we check #13 or 14, or both? 13 says "ONLY the last year's tax return" and 14 is optional for the last 2 and 3 years tax returns.

2) 2. We have claimed the Foreign Income Exclusion for each of those three years. The instructions to the I-864 say to put the adjusted gross income in lines 13a-13c. Due to the Foreign Income Exclusion, our adjusted gross income is $0.00. THat SURELY won't look good, right? My husband has been living with me outside of the States since we got married and all his income is foreign earned income. We do have my mother in law as my joint co sponsor. But 0?? Really??

or do we put in the amount we earned that we reported on our IRS form 2555 (Foreign Earned Income form) as foreign earned income?

Hi, I just called the NVC and asked about this, First of all he said for part 6 #5 to put 0 unless you have a job lined up already in the U.S. He said this question is reflecting the upcoming year. Regarding Part 6 # 13a, 13b, and 13c you should put the exact number written on line 22 of the tax return. So if it's 0 than put it. He said that it doesn't matter if it's 0 as long as you have a Joint Sponsor. Good luck!!

so given name is Haq than should i put MD Amirul as a surname or just MD

because he's passport didnt wrote name separetly they wrote full name MD Amirul Haq

What is his first name? What is his middle name? First and middle names are "given" names. Surnames are last names.

Ok another question..sorry. On part 6 of the AOS, the instructions state to put your annual individual income from part 5 on 6c. Later in that paragraph, it says if you meet the poverty guidelines, you don't include any household members income, so do I still put my annual income on line 6c and then write my own name as person 1 even though I meet the poverty guideline and don't intend to use any other household member's income? Its like it is contradictory.

Read posts 1 and 2. It's okay to call! Everyone does. If you want to wait the full 30 days before calling initially you can. It's up to you. If you wait for the NVC to initiate contact however, it takes months because they will postal mail things vs email. If you call, you can hand over email addresses and then everything from them will be via email.

The NVC is a very active stage. It's not like the USCIS where you just wait. You call them and get your case numbers, you pay bills, you do online forms, you send packages, and you call to find out if everything is complete and when you have an interview date. The NVC takes about 2 weeks to respond to emails vs calling which sometimes you wait on hold for 30 mins or so.

NLR and yukster - thanks for your answers! now NVC stage is more understandable. Im glad to hear this stage is faster and active one.
