The AOS says "not available" so I think we'll have to wait two or three days more for the invoiced. When we log in at the ceac site, I try to click on ds261 and it says there "please contact NVC if you request to change your agent/representative/lawyer" that's why I think our lawyer has filled it out for us already. But on the bottom where it says AOS and IV, it says "not available". I think you should ask your lawyer if he/she signed the ds261 already. We didn't ask our lawyer because when we checked ceac, it seemed that our lawyer completed the form for us.

Thank you for confirming this. We didn't check with our lawyer yet because of the time difference. It's okay as long as job is done efficiently and quick. All of this waiting!!!! Oh my (",)

now what should we do?

will be there any problem if we dont sumit 261?

or should i do it by myself and its say if i fill up anything wrong my case will be reject

If you have a lawyer attached to the case, then they're automatically selected as agent, thus no need for the DS-261. DO NOT FILL IT OUT.

Because a DS-261 isn't needed in your case, the IV bill should have been invoiced at the same time as the AOS bill.

Hi just an update.. NVC received our AOS package last January 22 and today we received a checklist regarding our AOS. Our checklist is about the co-sponsors' income indicated on line 11 of the I-864A does not correspond to that shown on the most recent tax return and W-2(s). What do you guys think about our checklist? Please help...

If you're asking if it's a false checklist, it's not. It's asking for something very specific. Sounds like the right line from the tax transcript wasn't used. Please read that question again as it states right in the question what amount to use.

Hi all!

We have encountered two questions on part 6 of the I-864, dealing with line/questions 13-14:

1) 1. If we are going to submit the last 3 years of tax returns (IRS form 1040), do we check #13 or 14, or both? 13 says "ONLY the last year's tax return" and 14 is optional for the last 2 and 3 years tax returns.

2) 2. We have claimed the Foreign Income Exclusion for each of those three years. The instructions to the I-864 say to put the adjusted gross income in lines 13a-13c. Due to the Foreign Income Exclusion, our adjusted gross income is $0.00. THat SURELY won't look good, right? My husband has been living with me outside of the States since we got married and all his income is foreign earned income. We do have my mother in law as my joint co sponsor. But 0?? Really??

or do we put in the amount we earned that we reported on our IRS form 2555 (Foreign Earned Income form) as foreign earned income?

Anyone knows? Thank you in advance!

I need help. I filed form 1040A on my taxes for the past three years. NVC is saying I put in wrong amounts?? I submitted my transcripts and put the exact number where it says income. Wages salaries tips etc. $28,442.00. Adjusted Gross Income has same number $28,442.00. How am I wrong with my numbers??

If you filed a 1040A, then, as it states right in the question, you have to use 'total income'.

my country is bangladesh but i am us citizen its didnt ask country of birth so should i put usa? or not?

My wife was worried she might get a checklist for AOS for income not matching as I-864 shows income to the penny but tax returns round up to the nearest dollar... Could that be it?

Surely they can't checklist everyone who is a few cents out because of this formatting difference?

but for me its different when i click ds261 its came form to fill up and i just fill it up but didnt send save it not sure should i send or dont?
