my lawyer paid AOS fees but he said that we dont need fill up and submit 261 form

now what should we do?

will be there any problem if we dont sumit 261?

or should i do it by myself and its say if i fill up anything wrong my case will be reject

can anyone tell me what question they ask 261 forms ?

is they ask lot of questions?

I think we're in the same situation. We didn't fill out the DS261 too, I would guess our lawyer already did this for us.

Hi all!

We have encountered two questions on part 6 of the I-864, dealing with line/questions 13-14:

1) 1. If we are going to submit the last 3 years of tax returns (IRS form 1040), do we check #13 or 14, or both? 13 says "ONLY the last year's tax return" and 14 is optional for the last 2 and 3 years tax returns.

2) 2. We have claimed the Foreign Income Exclusion for each of those three years. The instructions to the I-864 say to put the adjusted gross income in lines 13a-13c. Due to the Foreign Income Exclusion, our adjusted gross income is $0.00. THat SURELY won't look good, right? My husband has been living with me outside of the States since we got married and all his income is foreign earned income. We do have my mother in law as my joint co sponsor. But 0?? Really??

or do we put in the amount we earned that we reported on our IRS form 2555 (Foreign Earned Income form) as foreign earned income?

Anyone knows? Thank you in advance!

Did you subit original Birth and marriage certificate???

did you pay the AOS fees? i dont know if my lawyer did this too but when i login to ceac website its say ds261 not started

i dont know what will happen if i dont fill up this form anyone can answer please reply

If you have a lawyer, NVC automatically assigns him/her as your agent, thats why theres no more need to fill out ds261 :)

I need help. I filed form 1040A on my taxes for the past three years. NVC is saying I put in wrong amounts?? I submitted my transcripts and put the exact number where it says income. Wages salaries tips etc. $28,442.00. Adjusted Gross Income has same number $28,442.00. How am I wrong with my numbers??

For applicants in the Philippines, NBI clearance is the only one being required. But if you ever stayed outside the country for more than 6months, then you also need a police clearance from that country.

because in India they give our PC on ur passport name , and ur passport is still using ur old name

u should be ok.

for everyone its taking exactly 20 business days.

Thanks the issue is not with the name but the salutation used. Hopefully its not a big deal.

What I found was that foreign earned income doesn't count as income unless you didn't claim the foreign earned income exemption when you filed your taxes. I don't know if this info is correct or not. We filed 1040 and 2555 for the past three years also. We are confused about what to put in the income section. If my understanding is right, we SHOULD put $0 on there for 3 years!!!

Saylin or other respected NVC savvies, do you know anything about this or what's ur advice?
