From what I understand, you would be giving up the green card if you don't remain in the US, so I'm not clear on why you'd wish to complete the Immigration process. You would also save yourself the final costs of the process if you don't move forward.

Are you certain you don't wish to move to the US?

Certain like 100% no, but at least i want to do what would best for me to do to gain dual citizenship like my daughter and my husband, he can come back to Brazil when ever and i cant even visit my husband and my daughters country... if i lived there for 2 years would i gain the power to choose which country to live in??? what do i have to do???

Guys its been over 2 months since the approval from USCIS, and I all got is an NVC number... why havent i been given an invoice number yet????

on the link to DS-261, to log in, it says

If your case was not handled by the NVC (because the petition was filed at a U.S. Embassy or Consulate overseas), you will not have an NVC Invoice ID number.

we did NOT file overseas but would there be another reason why i havent been given the IN????

We got approved on NOVEMBER 25TH...


And our case was shipped to DOS.

I am going through the DS-261 screenshots.I am the Beneficiary & have given my husbands email add. Only the DS-261 i'll be doing it. Once it becomes available, i should enter myself as the Principal applicant?

Another question, under Personal information,i understand we have to give the given name & surname. My first name & surname is mentioned together in the given name in my passport & surname is blank. So should i enter it the same way in the DS-261 or i should put my first name in given name and surname in the surname??? Thanks.

Yes, the beneficiary = principal applicant.

I'd suggest using your first name as the given name and your surname as the surname.

Ok, thanks! I checked ceac and case is already in transit..when i called nvc, the lady said all concerns need to be directed to the embassy from now on..guess i'll just wait til embassy receives the case and ask them about the police report..

Yeah, give them a few days after they receive it to enter the case in their systems, then contact them.

Hey saylin I have not received approval yet but I had a question to ask. My husband's income right now is well above the poverty levels and he would be getting his tax report of 2013 as well. But the problem is he doesn't have his tax returns of the previous 2 years. So would one year be ok or do we need a joint sponsor? I just don't want any checklists so trying to prepare things in advance lol.

Just get the past 3 years' tax return transcripts on the IRS website. It's free and you can get them instantly.

Tax transcripts > tax returns anyways. And you'll need the income amounts to fill out a question on the I-864 (whether you submit all three years or not), so he'll need either a copy of the tax return or a transcript anyways.

I've read the "NVC Electronic Processing" link in your first post.

I've understood that a signed and scanned DS-261 form should be sent as part of the ENROLL email to NVC.

Does the ENROLL email "must" be sent from the petitioner email address?

Will the DS-261 become available only after the invoices are paid?

I am trying to find out how soon I can ENROLL.

What should be done first: DS-261, ENROLL, pay the invoices, or ...?

Also, I read in one of your posts about Loomis Express.

I've tried to find out by myself in Loomis website, but I am still not sure.

I've read the instructions from Consulate of Montreal, and it says "DHL".

Does "register with Loomis or DHL" means to create an account with a courier service?

Is it necessary to bring a "proof of Loomis registration" to the interview otherwise we are not be allowed into the consulate?

Could you please kindly answer my questions.

I'm not sure what you're reading, but the DS-261 is an online form, it can't be attached to an email. The opt-in email is sent without any attachments.

The opt-in email can be sent from either account. I, the beneficiary, sent all the emails (opt-in, AOS, IV). My husband, the petitioner, didn't email anything.

The IV bill won't be invoiced until AFTER the DS-261 has been submitted. I suggest you click on the flowchart either in my signature or on the first post. There's two tracks with specific things happening one after another.

Once you get a case number, the AOS won't be invoiced for a few days and the DS-261 won't become available for a few days either, so sending the opt-in email would be the best bet as you can do that as soon as you have a case number.

It used to be DHL, but then got bought out by Loomis. It's the same thing though. So every instance you see "DHL", just replace it by "Loomis". But, you're jumping ahead. Wait until after your case is complete, you have an interview date, and the case has been received by the consulate. You still have a few months before you should do this. And yes, you will be turned away and not even let inside the building if you haven't signed up and brought the confirmation page with you.

Please enlighten us, we're waiting for Case Complete status and my IV Package just received by NVC last January 30 and the AOS package received last Jan 17. Everything seems fine until yesterday, my husband got laid off from work because they don't need any contractor. My question is, how it'll affect my interview? I mean are they going to ask for additional/latest paystub and proof of income? I just hope my husband can look for a new job as soon as possible just to sustain the visa requirements. Although he has online business and GI bill I don't know if it's enough. What are we going to do? Thanks!

If the petitioner doesn't have a job, then he can't financially support you, which is the whole point of the I-864, to prove that he can. If he doesn't get a new job (above the poverty lines) before the interview, then you should look for a joint sponsor and bring all that paperwork to the interview.

hey saylin, im a full time student (med) obviously not working, my 1098T says 31,000 + , even thkugh i dont work, would this qualify me for aos for my wife? just woundering, i do have a sponsor but was just woundering

What exactly is that $31k? Financial aid?

If you're not working though, you can't support the beneficiary, thus need a joint sponsor.

This is the first I'm hearing of this. WE just got I-130 approval yesterday, My husband filed single last year when we were already married, does this mean he has to redo his taxes from last year? His dad is a tax preparer, and went through this with a client before. He filed the taxes with NRA instead of SSN and IRS sent it back wanting a SSN, so he did with ITIN, the IRS returned it again wanting a SSN. So I am seriously confused. Where did you get this information from? I have searched most of these sites and many others and this is the first time I'm hearing about it

How can you justify filing as single when you're clearly married? As I said in the post, doesn't matter where the spouse is, you're still married.

I'm not sure what happened with his dad's client, but the IRS do accept tax returns filed as MFS or MFJ with no SSN. I myself did it. Countless others did the same thing here on VJ.

Obviously, I'm not a tax preparer (nor am I immigration lawyer), so you don't need to take my advice. You can do what you wish. He can continue to file single if he wishes. Just be warned, if I was a CO, I'd red flag your case for fraud. If I were you (or rather your husband), I'd amend last year's tax return, and file as either MFS or MFJ for 2013 taxes.

If you want to get US citizenship, you'll have to live in the US for a minimum of 3 years. After 2 years, you file for ROC (removal of conditions), if you've been married less than 2 years when you do POE. Then, at 3 years, you're eligible to file for citizenship (as long as you're married to the same person). Once you get approved (which can take up to a year for processing and such), then yes, you can decide which country to live in (as long as Brazil allows dual citizenship, some countries don't).

Did you give over both email addresses when you got your case number? If you didn't, then NVC has no choice but to snail mail correspondence to you which can take weeks/months to receive. This is why it's suggested to give over email addresses. And this entire time, instead of waiting on correspondence, you could have just called up NVC and asked for the IIN. Sorry to say, but you've just been wasting time... I suggest you review the first two posts...

better check your kids immunizations record, i posted in the regional forum and got a reply stating that if your child lack one or more of the vaccines they will have their shot/s all in one day. theres a link in saylins post regarding the required vaccines... we may have overlooked this requiredment coz were busy chasing our case numbers.....

I'm praying we get case number this week. I-130 approval 12/23, Nebraska service center shipped this to NVC on 12/27, NVC received this case and being put in their system on 1/13... Currently been 14 business counting MLK holiday. So considering 10-20 business days for case number assignment this upcoming week should be the week! I'm declaring that right now. Anyone in our same shoes with these similar dates?

How many Immunizations required for my husband. He's currently living in UK on workers permit. Just trying to get everything ready. Anyone have any clue?

my husband is from pakistan on a student visa in the UK. He called and made an appointment yesterday with the medical people in London (I think they are called the Knightsbridge doctors). Anyhow, he told them that he didn't have his vaccination records and he said they will test to see on the spot and give him what he needs... they gave him a 3 hour appointment window!!!

I've been at NVC since 1/10. It seems like months and still no number.I think a typing instruction class is needed there.
